Hi all, 

 

I applied for i-129f and received a rejection notice, but I believe it is an error; what should I do!?!

 

I prepared the i-129f. I mailed it with a cover letter, bank check and all necessary documents. My packet was delivered on June 27th. It was processed the same day. About a week later, got a rejection notice with the entire packet returned with instructions to refile completely and correctly. I attached the rejection notice and first page of thee petition (this page was rejected) here. It says a section was not completed, my family name, on page 1 of the petition. I am going crazy because I have not left blank my last name, given name or middle name nor did i misspell the names on the petition. I am so confused. What do i do? 
 

can’t even call and speak to a representative about the matter. I emailed uscis to inquire, but no response yet. I am afraid if i reapply again exactly the same (because there is no error with names/spelling of names) that i may be rejected again. If anyone has any advice i would appreciate it.

Resubmit. Prepare a cover

letter that includes the rejection notice. Your cover letter should highlight that your family name was provided correctly in your original I-129F and in your newest I-129F. Include a copy your U.S. certificate, CRBA, naturalization certificate, or certificate of citizenship that shows your family name. Circle your family are in all copies of documents

You can and should request it. I doubt it will be granted.

You will not get the earlier priority date but can re submit the exact package as follows and it will be accepted for processing:

1.  On Rejection Notice handwrite w sharpie “ Service Error- Rejected in Error . Family name complete INSIST ON FILING “ 

2. On the envelope itself add : Attn Mailroom Supervisor: INSIST ON FILING 

 

***Its ok to use same form, make sure your Fiancé name is also correctly filled in***

Yes i have double triple checked. My name matches my passport and naturalization certificate. so i am completely confused. I even had family members check too.

Why does your first name change on 6b, 6c, 7b, 7a? Basically, is Damla your middle or first name?

 

Is this within your culture? Maybe this is why they're confused. I've never seen a case where a first name changes, unless you had a complete name change. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

It’s nor unusual  in North American culture for people to use their middle name as their first name

Mailroom Rejections are only for blank /wrong check marks / fields  ex ..in adjustment cases missing petition/underlying basis ) …and NOT reviewed for supporting docs. 
 

In OPs case , it’s just a human error, happens to the best of us. 
 

The “ Insist on Filing “ is their own internal memo on how to get past mailroom in those complicated cases…not really needed for OP ..

Its an official name change. My parents did so when i was a child. This is not my first time i have filled petitions. I have filed i130 and n400 for myself and i130 sponsoring my mom. I have always filed like this because i have an offical name change document and never came across an issue with it. Also, i provided my name change document with my current perition

There is a total of 17 (seventeen) spots where family name has to be listed on I-129F form. Any of the 17 could have been left blank. Best guess - check latter pages, where it's talking about use of interpreter and such.

 

Not a single spot on the entire form may be blank.

Yes i have checked. Nothing is left blank and fields are correctly filled.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
