Hi guys hope you doing well Since my case may get delay and probably the interview I'll have it until 2021 I was wondering My fiancé was employed for 5 days of the week 10 hours a day for $15 an hour. But after the pandemic she had got unemployed by her job and has been receiving unemployment since March. Do I show the income of of 2020 including when she was unemployed? Or will the unemployment payments not count and I'll need a sponsor
  2. Hello everyone, I am new to this forum and have been doing my research on the US Immigration process, hoping to understand whether the K1 or the CR-1 (I-130) is a better option for us. All of this is separate to the COVID-19 situation and the recent Immigration Ban. Some background: Boyfriend: US citizen by birth; lives and works in Los Angeles, CA Myself (Female): naturalized Canadian Citizen (2011) (original citizenship: Pakistani - no longer valid). Born, lives and works in Dubai, United Arab Emirates. We have been dating for about a year now (we met in LA while I was on vacation) and we are planning on getting married ASAP to live in LA. We see each other once a month either in the US or in other parts of the world (minus during the COVID-19 period). We were last together in Feb 2020 in LA. We aren't picky on where in the world we get married, as long as we are able to live together in LA as soon as possible, with the possibility of me working in the US sooner rather than later. I have a steady job in Dubai, and would not like to quit and move just to 'wait around' for the right to work, hence, the need to be able to work is crucial. If we were to categorize, priorities are as follows: 1) working in the US sooner rather than later 2) being together full-time 3) funds. i.e. OK to proceed with a process that allows me to work sooner than later, but which could take longer to enable me living there full-time (as long as we can continue our once a month visits globally - separate to COVID) vs. something that allows me to move quicker, but idle in terms of work. I have seen the below advice floating around on other topics within this forum. Is a lawyer recommended for either of these processes, or are these manageable on our own? It seems that the CR-1 option is better for us, however, once I apply, am I allowed in the US as a visitor just to meet him? Or do I need to wait until approval of this process? How long does the CR-1 usually take? Does my living/citizenship arrangement make it more complicated? If we decide on the K-1 route, how soon can I receive the EAD to work? (I know the below has timing guidelines, but we all know these aren't always the reality!) Thank you so much! I know this post is lengthy/detailed, but makes it easier to have the facts laid out to navigate the process!
  3. I have received an RFE for my Venezuelan Fiance to prove that she is divorced from her ex per commond law statute. The recept date is 4/17/200 and the due date is 7/13/2020. She sent me official documents in Spanish and I had them translated by a certified translation service. Her documents clearly show that she is within the common law statues of her state to be considered divorced. My question is, since everything is closed in Venezuela, including the office that appostilles, should I send copies of the original documents and the translations to the USCIS, with an explanation that because of COVID, we could not get the documents appostilled? Or should I wait until the offices open? I don't think the latter is an option. thank you for any and all comments

  5. Hello, Our K1 fiance petition got approved and we also have a DS-160 application number and confirmation. We've tried to follow the necessary steps but we got stuck at trying to schedule an appointment online for an interview. We have tried online several times to schedule, however it has always given us the no available appointments. I was wondering when is the payment usually made ? Is it before or after the scheduling of the appointment? How do you send the payment via mpesa or postbank? We have not made any payments, could this be the reason why we are not getting any appointments dates ? We would like to send the $265 payment via M-Pesa however we do not know the number to which to send the payment, or do we need to go to the Postbank to get the payment information? How can we make sure that payment is attached to our application and schedule an appointment? Any insight would be appreciated. Thanks
  6. Question: I met an Indian man online 7 months ago, when I was planning a tourism trip to India. We found we had a lot in common and decided to meet during my trip. We did that, and hit it off, spending the entire time together. Since my return to the U.S. we have chatted or talked every day, have developed feelings for each other, and are interested in pursuing the idea of being together long-term. We would like to take the next step in our relationship, which is to spend more time together dating in person and getting to know each other. And we both feel it is really important for him to come to the U.S. to see what life is like here and also to see where I live, etc. so we can decide where we might want to be together – there or here, and if at all. This is a quite normal and logical step in any relationship – to continue to date and get to know each other. But I’m finding that it seems impossible for him to just come and spend some time with me, due to the visa options and restrictions. From what I understand, he would almost assuredly be denied a tourism visa: he is 44 years old and single, lives in his parents’ home (cares for them), is self-employed as a tutor, has no children, etc. (I’m 51, single, male, self-employed). I don’t see how to convince the visa app people that we just want to spend more time together to determine if we want to be together long-term. The only other options I see are the Fiance or Spouse visas, both of which require us to MARRY just so we can DATE!!!! This seems absurd to me and flies in the face of the reasons for immigration laws in the first place. (Where is the Just Dating visa?!?!) They are essentially forcing people to get married. (Not everyone is interested in immigrating to the U.S.! If we DO decide that we want to be together AND in the U.S., THEN we can follow that route.) We are mature adults and both open to the idea of marriage but don’t want to be forced into it prematurely just so we can spend time together in my home/country. I guess I’m curious if anyone else has experienced this catch 22 and what they might have done about it. Has anyone been able to get a tourism visa by being honest about this (or not), or had a tourism visa denial then applied for Fiance/Spouse? Is that OK? We’re open to any creative ideas or advice. If we have to marry, I'm not sure which is better, fiance or spouse visa (get married outside of U.S.)? But again, marriage for dating purposes makes no sense…. We'd prefer to marry for love.   7. Hello all, I'm just trying this blog post to see if I might get some experiences from those of you on here. To make the story short and simple, my fiancé (in Manila) went in for her interview back in Feb of this year, Feb 6th to be exact. Her interview with the consultant seemed to be going great, she was able to answer all of the questions with enough detail and had all of the documentation required. However, towards the end of the interview, when she thought it was over and the consulate was satisfied. He stood up and went to his computer, was there for a few moments, then asked another Filipino agent to speak with her. They questioned her about a missing stamp in her older passport. While, studying abroad in Malaysia (legally, had a, student visa) she had decided to visit her aunt, whom was sponsoring her visa in Malaysia. However, her aunt was living in Oman; she was approved for a visitors visa to travel to see her. While there, she had to return to Manila due to some family issues that came up. So she was never able to get that return stamp apon returning to Malaysia to continue her studies. So she was given a 221G, filed under DS-5335. We sent all the required documents from her travels during that time. As well as the additional information sheet that was given. We received confirmation that these documents were received by the consulate a few days later. Here we are now almost 10 months later... I've had my lawyer send multiple inquiries to the consulate and to no avail, we are unable to get even the slightest information. Just the same copy and paste "we're still working on it" message. If anyone, anywhere on here has some idea as to why this issue is still ongoing, I'm all ears. My lawyer doesn't even know the reasoning as too why this case hasn't been approved or anything at this time. Thanks for reading, and I look forward to hearing what you guys have to say.

  9. Good day everyone and VJ family. Just an update on my K1 visa process, so received my case number October 1st which contains the details of my case some few Instructions. I tracked my case on the site and it shows ready I have gone ahead to pay for the visa fee and schedule an appointment but I haven’t received my packet yet from the embassy. I also notice they say you come along with DS 160 form unfortunately I have an existing profile on the portal so whiling filling I only updated my records like my passport number and expiry date of my passport. Please what should I do next? 1) Do I send the embassy an email requesting for my packet, which contains the instructions? 2) Since I couldn’t get any DS -160 form, printed out, how do I go about it knowing I already had a profile there I used for my B1/B2 visa application 3 years ago . Please guys I need your expertise on this . Thank you.
  10. Hey, Have read numerous posts on here but haven't quite found the answer im looking for. Received my Police Cert back with a 'No Live Trace'.. when i was 13 years old (12 years ago) i left a stupid (and obviously not serious) comment on a social media site saying 'lets kill' a teacher resulting in a juvenile reprimand. For this i was not arrested nor did i receive a conviction or go to court or anything like that. The school simply told me to go to the police station on a saturday with my parents to sign a piece of paper saying i accept the reprimand (formal warning). I had completely forgot about the whole thing until i received the ACRO certificate and my parents reminded me! I have travelled on ESTA for the past 2 years and i believe this has to be fine to do so as i have never bee arrested or convicted (which apparently means by a court of law only).. I have also entered on the DS160 form that i have never been arrested or convicted because again I havent.. Embassy interview is on the 21st Aug in LDN. Ordered my subject access request from ACRO on the 20th July, not expecting to receive it in time for the interview with the postage times. My questions are these 1. If i do not receive the SAR in time and take only the police certificate stating No Live Trace and a explanation of the details etc - is this going to delay my approval? (e.g not approved on the day)? ACRO have said that the embassy can contact them and they will confirm via telephone the details but surely this is not done during the interview? 2. Is the purpose of the SAR for the embassy not to have to contact ACRO via telephone? 3. Does what ive entered on the DS160 sound correct? Any advice would be great! Thanks Klouise

  13. Hi everyone! I’m confused on my application, had my interview last May 29 and the consul kept my passport and handed me a small piece of paper as to where I can track my passport. So the next day I check the ceac website immigrant section my case was AP. Consistently checking in everyday then on June 5 i can’t get through the immigrant section it’s very slow but it’s still AP. The next day I tried the non immigrant section and I got in but it still says AP, up until today. What confuses me is that today is June 10 but the case created and case updated date still says June 3. Is there something wrong? It’s been 9 working days since I had my interview. Can anybody explain to me what’s going on? Im so confused right now lol. Thanks in advance!
