Hello everyone,

 

Me and my partner submitted our i-130 a while back. But there are some evidence we didn't submit and want to add it to our K3 submission.

 

We would like to add proof that shows my spouse added me as a beneficiary to life insurance policy (from employer) and also retirement account (401k from Fidelity), and also as Emergency contact at workplace. 

 

Please where can we gather this proof and what documents should we use?

Just FYI, K3s are dead, and the trick of submitting them to speed up the process doesn't necessarily work.

Ask your insurance company to provide you with a letter that says he's added as a beneficiary to your account. Same with the fidelity account. For the emergency contact at the workplace, if you did online onboarding, you should have a tab that says "emergency contact" where you can see that. Screenshot, print. Done.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Timeline

I believe any evidence that is submitted with a K3 will be tied to the K3.  That is, when they administratively close the K3, the evidence gets closed with it.

they wont tied the additional proof to your i-130 application. it only stick with K3 application

Agreed.  I recommend that OP upload the additional evidence of the marriage relationship being bona fide after I-130 approval at the NVC stage, as an "additional document."

if you filed online, you can add the additional evidence to your online account, I did that to show I added my wife as beneficiary to my Basic Life and Voluntary Employment Life.

Oh thank you. Someone was telling me that that place is only to respond to RFE's, so I was confused if to add there.

But they will check all the evidence together from k3 and I-130 when making decision on k3 no?

But I believe that when they administratively close k3, they usually made decison on i130 same time

Obviously it is evident to the system .. and perhaps the USCIS worker .. that the person has 2 applications in place at the same time .. very different to thinking that both cases are opened, combined and physically accessed .. may well be an automated action by the system .. like having 2 flight bookings for the same airline, date and flight number will result in one .. possibly both .. being cancelled

I would say that they need information from the i130 to make a decision if you are eligible for k3. That makes them review the i130, so seeing that with everything, you don't qualify for k3, they deny the k3. But since they already check i130 in the process, they just approve it instead of going through the same process when your priority date comes.


Also, I got to learn that petitions sent by mail are also scanned and put in a computer.

We will never know the machinations of the actual process   Im doubtful that its as you describe but either way.. it happens .. eventually.. maybe.. hopefully
