Stable Union can mess up my process?

It is a deed registered at any Civil Registry Office in Brazil, and does not alter the individual's marital status – one remains single. Yeah, maybe it wasn't the best decision, time will tell, and I thank you all for the advice and the considerations. Its good for other people who might see this thread in the future!

 

We've already spent our resources, time and effort with the k1 and we have a plan ahead of us. It is really disincouraging to read the comments here because I know how long it takes, we're already sad that it takes this amount of time for us just to be together, but again, that is not what I asked in the main post.

It's not super simple to just withdrawal the petition and start another one from scratch, it's our situation, our decision and Ive tried to make that clear... But I think it didn't work 😂 

 

In any case thanks for replying to my question but this thread is adding some unecessary stress to an already stressful situation, so I'm out.

 

See you on the next steps! Good luck for all of us starting or in the middle of it 😊

Wow........account closed already ....Good luck, @mdantas.  I'm afraid you haven't seen anything yet.  The whole process is stressful and full of agony at times.  We all have to learn how to cope with it.  I hope you return because you WILL have other questions....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So many reasons why CR1 isn't a great decision for some:

religious reasons where it is important to live together after marriage

difficulty getting  married in home country/ third country

future step children over 18 years old

anti-vaxx (easier to file medical waiver when in the US)

 

K1 is an easier visa overall... many people get stuck at NVC with RFEs for small things delaying the process by 6-9 months. 

The K1 process might be long these days but the timeline is a little more transparent.

Utah online marriage solves that issue.  I think children between ages 18-21 is the biggie....

Hopefully Utah online marriage remains an option in the future. 

 

But, reading some situations... being married in the home country while waiting for the visa impacts benefits/taxes/living situation. So, some beneficiaries prefer to remain single before they move to the US.

I still 100% think IR1 is better 😉

There are definitely some circumstances where a K1 is the better option, but they are also highly unusual, if you aggregate them together I doubt it would add to 1%.

 

Perhaps the biggest non legit reason is using it as a try out period, see if it works.

The show has done much to perpetuate the myth of this being a thing.

 

Funny, they never mention that both parties have signed statements of intent to marry.  AAO decision depository on USCIS.gov is full of dismissed appeals for people who were denied due to not establishing intent!

The K1 was quicker pre-Covid, but now in most cases it takes longer than the CR1. 
CR1’s are now being processed a lot faster than pre-Covid.

K1 might use this as denial.

If it's just insurance, your fiancée can buy international insurance from here that will cover him for Brazil.

You are far along in the K1 Process.  First thing to check before you consider withdrawing is if you can still get the fee back.  

 

Back when my wife and I were considering solutions, the CR1 was not a good option.  As people have told you the K1 wait times are longer now.  But also is the CR1.  In addition most cartarios in Brazil require a 30 day waiting period for the marriage to take place, which probably means you fiancée making another trip to Brazil after applying for the marriage license.  Only after marriage you can file for the CR1.  You will also incur fees to get the marriage license translated to English.

 

However, a stable union in Brazil is not marriage.  You are not married and it cannot be construed as such.  A stable union is basically you proving you are living together and financially vested together.  That is not marriage.  That being said, I am not sure you qualify that since you obviously do not live together.  If your worry is medical insurance while he is visiting I just would not go there.  I would simply spend the little bit of money to get him insured for the visit if that is your worry.  There is just too much hassle for the stable union if he is only going to be there a few weeks.

 

You have to figure out what is best for your situation.  But you need to look at all sides

Neither is an engagement, but believe it or not, people have been denied for showing pictures of an engangement celebration. To the consular officer, it might look like a wedding. They deny people for that (not that I agree or anything, I'm just pointing at the risks)

Part of my other point.  For a few weeks of insurance is it really worth the hassle of trying to prove a stable union to the insurance company.
