Hey I flew to America in November 2019 to see my girlfriend but was sent home by Detroit customs for not showing any ties to my home country or having adequate money for a 4 week stay. They told me I’d need to see a US approved physician at the US embassy in London as I also suffered from depression at the time and I’m aware it’s mandatory for the visa process.

 

We’re now married and I don’t wish to move to America, the plan was for us to wait a few years and go back and forth until she can immigrate to the UK. Unfortunately she can’t right now as the kids are still in school and the father would never sign them off.

 

I used a B1-2 tourist calculator to see my eligibility of being accepted and I scored a bloody 3 which is a 0% chance of being accepted because I have no ties to the UK.

 

I don’t own property and I’m self employed, so I can’t even visit America to see my wife, I’m 25 years of age if it matters.
 

If anyone has any ideas please help us, she struggles to come back and forth as she has custody of the kids. We don’t know what to do.

I assume you had a much more interesting conversation when you applied for entry than is normal.

 

I have never heard of a B calculator and doubt its efficacy.

 

Maybe she should share custody of the kids to give her more time to travel?

I flew in on an ESTA, sorry I should have disclosed that. 
 

I used RapidVisa.com for the calculator.

 

She recently filed a PFA against him as he assaulted her, she has custody right now but he sees them on the weekends.

It seems your two most obvious routes (VWP & B2) for visiting the US are now closed as you have been denied entry.  What are the chances you and she can speed up the process for her to re-locate to the UK?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I assumed you sought entry on the VWP

 

RapidVisa is a bit of a joke, they ask questions that the Consulate does not so make sense of that.

 

Only way of knowing is to apply. You seemed to have ruled out every other option.

Youngest is 11 so we’re way off, she is bringing them to see me in April but at the same time it’s £1800 just for flights. 
 

We’ve been to Mexico a few times to meet and she’s been here, but again it’s very expensive.

 

Our options seem so limited for the next 7 years, we did plan to start her immigration process earlier for dual citizenship so when she’s ready to immigrate we won’t need to wait.

when rethinking all this ,  understand that it will not change your situation

as a mother ,  she will always want to be by her kids

as a  kid  they always want to stay with friends they grew up with

and when they marry,  she will want to be close to grandchildren !

and how does a man who assaulted his wife (or ex wife) have permit to have his kids on weekends!!!!!!

Here he would only be allowed to see them 2 hours a week under supervision (during work week) of child services

Well, you kind of went into the marriage knowing the situation, right?

 

To me it sounds like since you do not want to immigrate to the US, the long distance thing is the only option until her kids are 18.

This pretty much sums me up as a mom :)

It will be hard on both of them. 7 years of back and fourth will be rough if he can't visit. Definitely worth trying for a B. 

As for the abuse. It's not the first time they still let the kids see the other parent. Often times the courts feel since it wasn't towards the kids they are not in danger 😢

You're young and you were not allowed to enter the US on the ESTA because of insufficient ties and a medical condition?

Did the officer think you were trying to move to the US when you were just visiting?

Were you given any papers or was a stamp put in your passport? Did you sign anything? 

 

Are you sure you are able to apply for the tourist visa or did CBP tell you an immigrant visa is required if you wish to return to the States?

I've never heard of someone requiring a medical just for tourism purposes but I know different consulates have different requirements.

In what context did your medical history come up during all of this.  

My wife could have never visited the US to come see me after we got married.  

 

Our choices:  I visit her, I petition her, I move to her home country under her sponsorship.

 

You have the same choices, choose one and go with it.  On the immigration side we can help guide you through the process however visiting the US to see a spouse, once flagged, is pretty difficult to overcome because once on US soil one can simply adjust status and stay.
