Some K1 Questions (Coming from Canada to US)

Hey guys,

I am in the process of waiting to hear back from my K1 Visa, I am going to marry my fiance in the US and live with her there.

 

We filed on July 6th, 2020 and quickly got back the notice of receipt letter July 9th/11th (cant remember exactly)

Anyway, I struggle with anxiety and the unknown is killing me so I found this great site and thought I'd ask a few questions im not 100% sure on.

 

1) Her income is super tight against the required amount for support, so we are going to be using her dad who will fill out the form of support (I-134, Affidavit of Support).
Is this correct? Should she fill one out also or just the dad?

 

2) We had 0 intentions of her attending the interview with me as we aren't rich and this process is already very hard and straining, I didn't think this would be a problem or a thing people even did until I read this form a bit, Will I be fine to attend myself? I have lots of proof of  in person meetings etc, I stayed with her for 6 full months in US before and have visited prior to that for a 2 week period, She also has come here for a week.

 

3) When we filed in July, I'm 99% sure we put Halifax as my consulate, I just picked the closest one, Now I see you have to do the interview in Montreal.. is this going to be a problem or will they simply update it to Montreal?

 

4) When I book my flight to fly to USA to marry her, Can it be one-way since we will do AOS right after, or will this be frowned upon since im entering on a 90 day visa.. I just don't wanna waste money on a return flight when im not even coming back but im not sure if border agent would have a problem with a 1 way flight on a K1 or not.

 

5) What is a realistic estimation on when we will hear back for the next step?

anyone else going through this I sympathize with you so much, This is such a difficult thing to go through when all you wanna do is be happy with the person you love.

3. no problem.  DoS always ignores that field.

Your K1 is specifically for entering, marrying and adjusting status so this will not be frowned upon. If a oneway ticket is cheaper, go for it! Otherwise, book a return and cancel the return once you are in the US.

 

You also mention money being tight. You are aware that you will not be able to work (and therefore contribute to the household financially) until you receive your work permit?

 

Is there a specific reason you chose the K1 (fiance) over the CR1 (spousal) visa?

OW or RT doesn't matter.  It is a visa with immigrant intent.

It can be a one way flight. Regardless Canadians are permitted to to be boarded on one way flights to the USA unlike most other nationalities.

Thanks again !

One way flight. No need to waste your money. 

You won't even be able to travel until you get the EAD/AP card or the GC -whatever happens first-.

 

And a suggestion: once in the US, get your SSN as soon as you can.

Thank you, Yes we are going to file for AOS as soon as we are married.

I can stay in the US as its pending right? Arrive on 90 day, File for AOS and then just wait, We plan on filing the application for employment + the AOS right away

You must stay in the US.

And you can get the SSN separate from AOS. Will make your life easier.

Doesnt matter either way.  Cheapest option

You aren’t leaving the US for a long time, a one-way is not a flag

You will be waiting 8+ months for the work permit/travel card.   K-1 is indeed an odd choice if money is tight.
