Critical situation!!! Spouse Wants to Leave. 1-751 please help me!

Hi guys, short long story!

 

I and my wife get married 3 years ago. She lives in NC and I’m living in Maryland as student in engineering collage. I usually visit her every 3-4 months for couple days and then back to my collage.
 

We jointly submitted our 1-751 package almost 9 months ago. Few days ago, she sent me text that she doesn’t enjoy having sex with me for some reasons I can’t fix or do any thing with it and also she love having sex a lot and I can’t afford that due to my collage and living apart.
 

She told me we can be like friends or i can find “ boyfriend or so” I was so shocked from that and she hurt my feelings with her texts. I’m posting here now because I don’t know what to do with my permanent status!!!

 

I don’t have the money to hire attorney. Please I need your advice!! I don’t know what I should do with immigration if we get to interview!! 
 

she didn’t ask for divorce but I can say she may ask anytime!!! I can expect anything from her this time.

 

please help!!

You can still remove conditions if you divorce your spouse (you can file for divorce any time you want) but I believe the fact you have been living apart is already going to be an issue. How long have you been living in different states and only seeing each other a few times a year?

Since you have already submitted your I-751 jointly with your spouse, I am not sure what the process is for that. I'm sure others more knowledgeable than me can weigh in. 

 

For the first 2 years of your marriage, did you live with your spouse that entire time? Have you comingled your finances throughout your marriage? Do you own anything jointly (car, house, etc)?

I came here on student visa and then we met and married. We are same age and she have decent job. I don’t have house or car but we lived in same state for 2 years and every weekend we are together and I met her family many times. We have pics together, insurances, bank accounts, flights and bus tickets, hotel reservations, lease under our names and messages between us to prove how our relationship was. I don’t know what to do next and can’t even think!!!

 It seems you are not worried a bit at all about her having a potential bf for satisfaction only while married to you.

 

Anyway if you think that's the way to go, divorce ASAP and change your i751 for divorce waiver.
