Logistics questions here: When putting the packet together, did you put the check on top of the cover letter THEN put the G1145 and I 751 or did you put the G1145 on top of the cover letter with the check so they see that first?

It was posted in an earlier page that if your case is routed to a service center  MSC you are likely routed for interview scheduling. I assume that would be at your local field office. Here is the link to the info:

Yes it was suppose to be US Department of Homeland security.

But later on after reading alot of post about it..i saw people have been fine writing USCIS too. You might b ok dont worry .

My husband's earliest date to file was 11/23 but didn't want to send it before Thanksgiving holiday and needed one more affidavit from my mom. Sent it today via FEDEX 11/27 and it is scheduled to arrive 12/1...oh so maybe I'm a December filer. lol.

Damn! We've sent them tons of evidence, hoping for a waiver all together, but it looks that they've decided to inconvenience us with an interview! Oh well, let's just hope they schedule it soon! Thank you!

Did you come in on CR1? If you haven’t had an interview yet I think that’s why. That’s what I am seeing here anyway. Hubby came in on K1 so we had an interview for AOS. I’m hoping no interview since we had one already but not holding my breath!

No, they are not inconveniencing you. You came on a CR1, therefore you didn’t AOS and no interview. By law USCIS will interview you at least once.

I don't think that's true! There is no law that says they have to conduct an interview at least once. If there's one, maybe you can point out the article? It's really up to the agent reviewing your file, and like everywhere else, some are competent and know what they're doing, while others are just checking boxes and fulfilling quotas! It is my understanding that if you provide enough evidence to prove a bona fide marriage, they could (if they choose to) waive your interview. Anyway, it is what it is, we have sent plenty of supporting docs showing and proving our bona fide marriage (commingling funds, travel records, mutual property ownership, insurances, bills, affidavits, and even a baby together), but it's still an inconvenience for us and a waste of their already limited resources. Good luck to all of us!

@ra0010Thanks for sharing, but these are just GUIDELINES, not a laws, as mentioned in your earlier post. Furthermore, as you can see, they start off by saying  "All adjustment of status applicants must be interviewed by an officer unless the interview is waived by USCIS.[1] The decision to waive the interview should be made on a case-by-case basis" IOW, the officer may exercise his/her own discretion to waive or proceed with the interview. To my knowledge, there's no law that says they must interview you. Cheers!

Fair enough, I think I misused the word “law”. But my understanding, from all my years here in VJ, is that, since CR1s do not adjust status within the US (thus no AOS interview), they get an interview for ROC. Most of the times if you went for an interview for AOS, you won’t have one for ROC (although in some cases they do interview twice, one AOS and one ROC).

Conversely, I think I’ve seen only one case that went all the way up to naturalization without interview.
