ROC -interesting questions ! (merged)

Hello , Everybody !!! I

Three  Questions : 

1- I received  one of the immigration lawyers I-751 cover letter as sample for what to prepare in the check list , in the buttom of the letter , its very interesting ! read this :

Pursuant to 8 CFR §216.4(b)(1) and in consideration of the enclosed evidence we respectfully request that the interview requirement be waived.

I appreciate your prompt attention to this matter and respectfully request your favorable adjudication of this petition.

( I googled that 8 CFR §216.4(b)(1) ,  wow!  a lot of great info ! it really talk about if you have from A-Z evidences you can request to wave interview base on that law code !! )

 

"Question, Can I included that in the cover letter even I am not a lawyer ?"

 

2- I received the affidavit from friends & neighbors ( they are obviously very busy people and took the time to write and notarize and I thank them so much for that )

However I see  my name miss-spelled in one of them ( one letter wrong) ... The 2nd affidavit  , printed out in away .. the last word or letter in each line missing , due to printer alignment as it seem   .. I know they are busy and I don't want to take their time again .. 

Is it possible I take it to the notary myself and show the typo to be corrected by the notary person? ( Obviously the signature of the writer already have been notarized, all I need to fix the typo without effecting the legimtacy of the affidavit and without disturbing my neighbors again ! 

 

3- I see in the thread , if you do ,Money Order ? or Cashier Check ? it will be cleared same day Vs. personal check they have to wait on the check to be cleared ?! if that true 

Can you elaborated on the  money order or cashier check , what exactly to be written on it please ?

1. I wouldn’t include it. It’s up to the officer whether the interview is waived or not. But if you didn’t have an interview for AOS, most likely you’ll get one.

2. Don’t even bother with affidavits. They’re secondary evidence. Instead, focus more on stronger evidence such as combining finances.

3. We did personal check for AOS and had no issues.

1) I included the statement in our application's cover letter, not sure it makes any difference 

2) If the affidavits are usable include copies, but do not modify them in any way, submit true copies without making any changes. While they are secondary evidence, they are not valueless as evidence. USCIS lists them as valid proof of a bona fide marriage so include them if you have them.

3) We paid by personal check from our joint account

Affidavits are value less if you have other stronger evidence .

Sure, but if you have them they are not valueless, your application would be stronger with them than without them. USCIS indicate they are evidence they will consider so you are better off with a good affidavit than no affidavit at all.

 

I would not do just an affidavit alone or in place of joint tax returns, 2 years of bank statements, joint lease, or children birth records but adding them can only help your i751 case. USCIS looks at the total evidence submitted, not just one thing or another.

1. If I were an IO, i'd definitely schedule appointment for one who asks for its waiver. Just a thought.

 

2. You change one punctuation mark, it will no longer be an original affidavit. You cannot be making edits to someone's affidavits, that will takeaway the entire concept of affidavits. The notary's job is to simply make sure the person signing the affidavit is the person who prepared the affidavit. He/she has no authority to edit them.

 

3. My preference is money order.

1. They know about their own regulations. No need to explain to them. If you had an interview in the US before you most likely won't have another one. If you haven't interviewed with USCIS in the US before you'll most likely get one. No matter how much evidence you sent or what you ask for.

 

2. Affidavits are weak evidence so if they're not in a good shape and you don't want to ask for new ones just toss 'em.

 

3. A personal check needs to go through the bank routines and that takes a bit till it's cleared and till that happens USCIS don't know if it will actually clear. For money orders and cashier checks you already handed somebody the money to get them and it's basically secured that the money is where the check says it is ( does that make any sense? )

Can you tell me what should I write on the money order or what should i tell the teller like to who the money order/cashier check  for ?

Tomorrow hopefully I go to the USPS office .. to send the packet if get done organize everything tonight ! 

2- the USPS Lockbox address listed , can i send certified mail require signature for it ?

1. All you need to tell usps is for how much and pay that amount+Small fee. After getting the money order, you'll write write the info same way you would write a check.

 

2. If usps just send priority mail. It's delivered to a PO box. Adding signature confirmation will delay the delivery.

I really need your help please ! So I purchased the money order today from the postal office. I am confused about the information to put on it ! 

especially on  the right side of the money order 

1- on the right side - which name I should put ??  " is it the bank account owner I am the US Citizen  and made the money order through my debt card should my name be there ?"  OR should I put my wife name the ROC petitioner please ?? 

2- Should I sign somewhere on it on the right side , or No signature needed at all ???!

Put your wifes name and A#..on it.  Make it out to : US Department of Homeland Security. no need for your name or signing
