Needs Advice

USCIS sent a letter to my wife about intent to deny my I-130 due to my divorce document found to be fraudulent and dated from January 20, 2016 which I did not pay attention to. And also my nonimmigrant visa stated married and obtained in February 1st, 2016. Please advise me on What do i do? Thank you.

You didn't 'pay attention' to the fact that you submitted a fraudulent divorce decree?

 

Lying on visa applications and petitions has consequences.  Sounds like she will be moving to Nigeria.

I think we need a little more information.  When were you previously married, when was the divorce finalized, when was the non-immigrant visa approved?

I do not think he was. He put married to improve chances of getting visa. He got visa, got to US , tried to undo the "marriage" story hence the fraudulent divorce certificate.

The problem is, they think these files remain overseas. They do not understand that an IO in the remotest part of Alaska will pull this record in 5 mins or less.

He is half-way honest though. So I give him thumbs up for that. He just needs to fully give us the exact chronology of the story and we can give answers accordingly.

Any previous marriage must have been dissolved prior to your current marriage.  Why would USCIS think your divorce decree is fraudulent?

There is not really anything to do, US will not recognise your current marriage without evidence that the previous one was terminated. You need a valid marriage to adjust status.

 

Presumably you entered as a visitor, have you overstayed?

You would need to provide a lot more details on dates, documents, your actions, etc., for any of us to understand the situation.  Start by writing everything down with your wife, and seek legal counsel for assistance.  You are most probaly in big trouble, but maybe you simply submitted the wrong documents; declaration, instead of final decree, or whatever is required from you - https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html

I concur with this being a Lawyer issue and not DIY, now quite what a Lawyer can do I do not know but at least they will have access to all the facts.
