Please help. Pregnancy during administrative processing

Hello. My interview was in January 2020 and administrative processing has continued since then until today (reason not reported). Then my fiance and I met in another country in November 2020.  It so happened that I got pregnant by my fiance. Now we don't know what to do ... file a lawsuit against U.S embassy(which is very expensive), or get married, or wait. I need some advice🙏

Timeline

Filing a lawsuit might result in a consulate decision you don't want.  Whether you marry and start the CR-1 process is a personal desicion.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It's up to you to continue the K-1 or marry and file for a spousal visa.  It would take 12-24 months to get a spousal visa during processing.  Longer with COVID.

 

You need to be patience and wait for the US Embassy to start visa interviews again.

I mean they working now. Just one girl from administrative processing group chat got visa after year...it seems their lawyer won the case

Since you've already had your interview, I definitely wouldn't recommend starting over with a CR-1 unless your K-1 is actually denied (though since it's been over a year, you will probably need a new medical before your visa is issued).

 

I think it's unlikely this is going to be resolved in time for you travel to the US before your child is born if you're already 5-6 months along (and getting on your husband's insurance and finding a doctor you like in the US isn't something you want to be scrambling to do with only a month or two to go before your baby is born anyway) so you'll need to look into getting a CRBA for your baby so he or she has US citizenship.

I don't think marrying and starting over with a spousal visa will benefit the immigration speed issue.  There is always a possibility of a long administrative processing period for it, too......18 months from now.

Unfortunate timing, but pregnancy is not a valid reason to expedite, nor can AP be expedited anyway.

 

Maybe your fiance can come to Russia to be with you for your pregnancy and delivery?

Russia mostly isn't currently issuing the appropriate visas for that (or letting Americans with existing tourist visas visit), though maybe that will change in time for him to get a visa and tickets before the baby's born?

Greg Siskind’s firm are currently onboarding until April 26th for a mandamus suit against Moscow. Just search for K1 Moscow mandamus case if interested

 

With the current political tensions between the US and Russia, the situation at the Moscow consulate is just going to get worse.

With the current political tensions between the US and Russia, the situation at the Moscow consulate is just going to get worse. 

Most of those lawsuits are designed to force consulates to conduct initial K-1 interviews.  OP had an interview, and is in AP.

 

A WOM for a case that is in AP forces a decision, which can be a denial or an approval.
