I-751 APRIL 2021 Filers (Removal of Conditions)

So, today I got a notification that my N-400 interview is schedule a month from now. The problem is that a week ago I submitted a withdrawal form since my spouse and I have been talking about divorce proceedings. I even uploaded said withdrawal form to my online application and sent a copy to my local office. I am not sure why they would still schedule me for an interview despite this. Also, this is N400 is based on marriage. Any thoughts? As I am confused.

Do you have 10 year green card? If so, nothing to worry about. Maybe you should still attend the interview and tell them you sent the withdrawal.

Then I would say you must attend, together with your spouse. And if possible, talk to an attorney / ask them to come with you. This may be a tricky situation.

why did go  this far... why now? goto your interview and then get divorced....

Hey

I’m still at the same stage. I-751 stuck on biometrics in the large Nebraska Abyss and n-400 is actively being reviewed. I think the word “actively” needs replacing. Although case has recently moved from 11 months to 4 months. So now still waiting.

I am sorry to hear that. My case has also been in active review but yeah, that means nothing. Hopefully you get a combo interview and that'll be the end of it. 🤞

You should go to the interview, even if you and your spouse are separated and divorcing then you should withdraw the n400 and if it is a combo i751/n400 interview then convert your i751 case to an divorce waiver case and/or an abuse waiver case if applicable at the interview.  

 

You can submit a letter to the USCIS officer to request withdrawal of the n400 and a letter to convert your i751 to a waiver case.

 

I would strongly advise you to get legal help navigating this complex immgration case.

 

Bring proof for your i751 case to support bona fide marriage, you filed for a divorce, and/or evidence of abuse (if needed). Be prepared to do your i751 interview. 

You will get a request for evidence for a divorce decree if you convert your i751 case to divorce waiver case.

K1 Visa Arrived USA July 2017

Married August 2017

AOS Approved July 2018

 

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

Hey occasionally come on here to see what’s happening with others. Have not written in a very long time…but as things drag on and curiosity how others are doing…thought I would just update on our situation. April 7 2021 I-751, April 7 2022 N400. Both no news….but like you wrote, lots happening here so hoping it’s soon for all of us.

Just got my 10 year card on the mail, no interview required (I need to update my timeline). I filed on the first days of April 2021.

 

I've haven't filed N400 yet, I need to start working on that.

Biometric Completed: 8/4/2021
In line for Interview: 12/30/2021
Interview Date at Newark, NJ:  Interview waived and approved on 09/14/2022 during N400 interview. It wasn't a combo interview; it was just N400 interview but I-751 was approved along with it.
