Anyone bought a house during I-751

Hello, 

 

So we are currently pending receipt for our I-751 application. My green card expires March 20th. USCIS got our application March 4th. We are also in the process of buying our home and wondering if anyone has successfully done this before? We are due to close on April 20th and I’m concerned about the bank not processing our loan because of my green card being expired,

We did, and there was no issue whatsoever. I’m not even sure we had to disclose my immigration status, just provide SSN and copy of DL. Easy peasy!

Immigration status has no effect on such matters. But obviously, keep original documents and copies as they will be handy to display to USCIS in case you get called for I-751 interview.

OK, but since you have applied for I-751, your green card is automatically valid for an extra 18 months - have you received the I-797 letter yet?

 

I wouldn't worry too much... now that I recall, we both had to submit a letter of employment, immigration status was never a cause of concern for the bank. Like mushroomspore said, the loan paperwork is actually great evidence for a bona fide marriage upon review of your case and interview.

I did and submitted my green card and the extension letter. They called me to ask some questions and clarifications and it wasn't an issue after that.

We did have issues with it. Better.com denied our loan because I can “technically be deported”. We went with a local lender instead

Wow... I thought I read in a different topic  on VisaJourney that some other couple in the process of I-751 was dealing with the same issue with the same lender. Sounds like a huge liability to me just because they don't have their ducks in row/knowledge that even conditional Green Card holders are legal PERMANENT residents. Good to know that if we are ever in a position to apply for a mortgage, we won't be going with such an awful financial institution.

My wife and I bought a house before she even had her greencard. (We are in AOS, Just had our AOS interview scheduled today)

 

Technically, HUD/FHA only requires a valid SSN and Work authorization with 2 years of work history. (If close to expiring, they need to see evidence you plan to renew)

 

This was for a FHA.

 

At first my banks internal risk management declined the loan due to my wifes status +EAD about to expire within the year.  My loan officer contacted FHA and got a risk approval from some big guy over there 😅.  Delayed our closing about 30 days but we still closed.

Of course it's FHA.  Conventional loans are up the the banks own guidelines.

 

I'd think the fact you filed your ROC would be enough evidence from USCIS you will have your work authorization renewed .

 

My wifes AOS I797c was enough.

Ever since the Patriot Act was passed, mortgage lenders have demanded a copy of my green card.

 

Your extension letter should be fine. If it isn't, the bank is discriminating on basis of national origin and should be reported. https://www.consumerfinance.gov/ask-cfpb/my-application-for-a-home-mortgage-loan-was-denied-what-can-i-do-if-i-think-the-lender-discriminated-against-me-en-342/

Ours is a conventional loan. I’m just hoping I have my extension letter before April 9th but that’s only a month after USCIS got our application.

So the first time I was asked my green card, I read up on the patriot Act and concluded the lender wasn’t required to demand proof of LPR status but nothing prevented it from demanding proof.  
 

Proof that you’ve paid for RoC might or might not convince them.
