Worried about our evidence (already a natural worrier lol)

Hello all,

 

Were about to send off my I-751 ROC packet in the next few weeks. I am concerned about our evidence because 1. I'm already a natural worrier as a person LOL 2. I know we are a genuine married couple but this stuff still makes me anxious as I don't want to have to return to the UK without my husband & newborn son! (again, overthinking worrier here).

 

Here is the evidence we have:

 

Me listed on my husband's health insurance & dental insurance (copies of health insurance cards also)

Me listed as a beneficiary on my husband's pension package & life insurance

Birth certificate of our newborn son with both our names listed

Apartment leases over the past 2 years with both our names & signatures

Copies of 2019 & 2020 joint tax return's

Cell phone bill with my cell number on the same plan (all utility bills are in my husband's name, we didn't think to change some to my name, so this is one of my worries)

Photo's of us together, with family & our baby

 

Bank statements - we have both our names on each other's bank accounts, will 4-6 bank statements for the past 2 years be acceptable? we use separate cards but transfer money to each other, is this acceptable?

 

Will this be enough?

30-Mar-2019 - Letter with interview date received in the mail!!!!!!! :D

30-Apr-2019 - AOS Interview!  :star: - APPROVED!!!!!!!!!!!!!! :D

03-May-2019 - AOS (I-485) Approval notice letter received in the mail

That seems like pretty good evidence.  Very, very few I-751s are denied, so don't lose sleep over this.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Remember - you need to be sending in evidence FROM THE TIME YOU WERE MARRIED!  I know there will be some duplication, since your profile says you were AOS, but do have evidence from your marriage until the present day.  You have all the right stuff in your list - but you might need to go back more than just two years.

HUH!!! I only sent things from from after our AOS interview. I didn't even sent a marriage certificate as it wasn't on the USCIS list of items.

You got lucky........this is a common reason for RFEs.

Having a child together doesn't instantly prove something Is bone fide and not fraudulent. There's plenty of reasons people don't have children together and are able to show a more bone fide marriage. 

 

But yeah, OP is fine.

I always think it is best to follow the instructions on the forms.  Congrats on getting through.  Most people are issued an RFE.

You got way more than I ever sent or was asked for.

Do not forget to have both names tied to the same address. (I was so busy trying to prove I lived there I forgot to include the drivers license of the wife)

I did not include any of the evidence from the AOS part (it stated on the form that already submitted evidence did not have to be resubmitted).
The ROC RFE I got stated what they had on file (all evidence of AOS petition) and what was missing (all evidence submitted with ROC petition).
There is no harm in sending paperwork they already have so you might as well include it.

More stuff ended up missing during the interview (and the following N400 petition). So I strongly recommend to keep an exact copy of all petitions and supporting documents you file and bring anything and everything you have ever filed with you to any interview or even bio-metric appointment.

Well, many in the groups on this site only submitted from AOS interview to ROC and got approved. I'd be happy to dump all the ####### from the wedding to the AOS interview, but that seems stupid since its all in my file (which we saw at the interview). Bring on the time suck RFE if need be, I have two extra full copies on stand-by of the K1 and AOS packets they can have. 🤷‍♀️

My personal answer, yes, that's definitely sufficient and you're not from a high fraud country to begin with. And honestly, I personally did not submit any utility bills for my AOS and received my 2-year GC just fine. Mailed my ROC paperwork in December 2020 and no utility bills sent in either. Good luck 🙌

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
