Hi all,

Does anyone know about the process of withdrawing a case?  He has done his interview and waiting for his visa. So my question Can I withdraw his case without him knowing that I done it?   please help if you are familiar with the process.

You will need to contact the US Embassy/Consulate to withdraw the case.

When he's refused a visa, he'll find out that you withdrew the case.  Not something you can hide.

but can he reinstate his visa? does the embassy accept to reopen a case?  I don't care if he finds out but I am more afraid of what if he finds out and he  could come. He is dangerous but I can not prove.

I'd email KabulIV@state.gov with case number in subject line along side I-130 petition withdrawal.

Then include a letter (copy paste into email and/or attach) stating that you as the petitioner (include full name, DOB) are withdrawing I-130 petition submitted on behalf of PERSON's full name, dob, passport number. Also withdraw the I-864 at the same time so they can't issue the visa.

Don't need to provide a reason on why you're withdrawing your petition.

thank you so much

No, he can’t reinstate a visa if the petition is withdrawn. I’d play this on two fronts - email the consular iv unit withdrawing I-130 and I-864 (for good measure cc NVC and send the letter to USCIS as well) and call up ACS (American citizen services) to report this - they’ll probably just take your details and pass it along to IV unit but that’s two reports in there. Their email is KabulACS@state.gov

If he is dangerous...do not facilitate him moving here please...withdraw his petition at the embassy and NVC level....call the embassy to inform them.

Make sure this is the step you want to take before moving to do it. Once done, it's irreversible and you would have to start from step one if you decide later to petition for him again.

And in case,  visa has already been issued or in printing process,  report to Department of HOmeland Security Nebraska office

Address: 1717 Ave H East, Omaha, NE 68110

so he can be stopped at POE as his info will be put in the computer system
and trust me on this one,  they will take the report seriously

To clarify,  he is a relative. I did not Sponsor him, he won a lottery. The reason i don't want to withdraw is because he trusted me I did all his paper works since he can't  speak english.

Are you providing a I-864 Affidavit of Support only?  What exactly did you do for him?  Has his visa been issued?

You can not withdraw his DS-260.  You can not withdraw his case since he's a lottery winner and you did not file an I-130 for him.

Wait, what?
If you provided I-864 you can withdraw that but if you only helped him complete paperwork not much to do - hopefully you listed yourself on forms as the form preparer/interpreter if he can’t speak English.

Now if there’s something potentially problematic about him and you have knowledge he may be up to something bad - email embassy (those two emails listed) and involve DHS/CBP and even FBI.
