K1 Visa

Hello Everyone. 
I don’t think anyone will know the exact answer to this but any ideas or suggestions would

be great as I am getting overly anxious with each passing day. 
I know they are currently not processing K1 visas at US embassies around the world due to Covid-19. However, does anyone know or have an estimate of how much longer they will not be processing K1 visas? I saw somewhere online today that it might be until December till they start processing K1 visas. And this is making me

extremely overwhelmed and anxious as we have waited already over 2 years for my fiancé to come to the states.

If you filed a K1 over 2 years ago, it should have been processed long before the Covid started. Most were processing from filing to visa in hand in 8-9 months, worst case 12 months a few years ago. your fiance should have had his visa a while ago. What month/year did you file?

why would you want to file K1 if your fiance is in the US ?

He is not in the states! We are still waiting for him to get his visa.

No one knows. It hasn’t been announced. The way the US is handling COVID I wouldn’t be surprised if they stopped ALL immigration for a year. Germany hasn’t announced the processing of any visas at this point https://www.ustraveldocs.com/de/

Yes I know he should have been here by now. His interview was last March 2019. After his interview, he was put under administrative processing and has been ever since his interview last year. 
We filed in May 2018. His interview was March 2019. After interview was put into administrative processing 😕

Over a year for AP is highly unusual for Germany or any EU country.  I have only heard it taking that long for Pakistan and a few other countries.

 

Did you follow up with the embassy and/or your congressman?

I am sorry that is taking so long. I can only think that something got lost in the mail regretting your case. 

I am sure you like, already done this. But did you sign up for https://egov.uscis.gov/casestatus/ ?

 

Also you can write your local State rep asking for help and information. They might not be able to get it done now due to Covid-19. However, they might be able to give you some answers. 

Also someone with more experience, correct me, but doesn't the  221(g)  form come with the reasons for it and the steps how to correct it? Like you will know why the visa was refused and placed into Administrative Processing.

The main one I been reading about online has to do with the background check or the Validity of the Proposed marriage. 

Maybe if it has been two years, you should seek experience legal advice.

you cannot circumvent Administrative processing. with the backlog it will be a while. no one can tell how long

Unfortunately being in AP can take a while to clear.   If he not from Germany?

They did issue 53 spousal visas last month so some work on existing and expedited cases is taking place.

As mentioned in the other thread, the reason for his AP is likely his country of origin and travel history.  The answers are still the same:  AP cannot be sped up or waived.  This would be the same even if there was no pandemic and embassies were processing K-1s.

No one knows. They make up the rules as they go along. And they only tell us the rules after they make them up. They'll reopen embassies sometime, maybe, or not, if they want to. This is how representative democracy looks in 2020.

I know and totally understand that AP can not be expedited, and that was not my question. I don’t expect for our AP to be expedited. I just want to know when they’ll resume processing K1 visas because right now whenever I email the Consulate in Frankfurt, they won’t even give me an answer on our case or even an update because they are saying they aren’t processing K1 visas. When I use to email them before Covid19 they would at least give me an update and let me know what was going on with our case. Now it’s just oh, we aren’t processing K1 visas right now.

Not sure what you're looking for here.  If the embassy cannot give you an answer, it is unlikely that any random person on VJ can.  K-1 is not a mission-critical visa category, so they will not resume processing until they have made a dent in the mission-critical category backup.  And K-1s with added complication of AP may take even longer.  There is just no way to know.
