Long-distance relationship - Immigration in a non-COVID scenario - K1 or CR-1?!

Next we're working on the NVC process! I'm guessing there will eventually be a slowdown because of the closure of embassies but so far NVC has been pretty speedy!

I had a random thought over the weekend - do we need to be married for a certain amount of time before applying for the visa? or can we marry today and start this tomorrow (hypothetically - of course have to wait for covid to settle and for the license to come through)...

We submitted both passport photos and the birth certificate when we filed...I'm not sure if those requirements have changed since then though. 

 

Also, as far as I know there isn't a restriction on how long you should be married. We got married less than 2 weeks before we sent ours in. However, I believe it makes a difference in the type of visa that will be issued (CR1 vs IR1).

Does anyone know if the beneficiary is supposed to sign the I-130A form if they are abroad? It says at the bottom to ensure everything is filled out correctly otherwise USCIS will reject, but there is also info online that this may potentially not need a signature?

Hey @RandW - it's been a minute since I revisited the police cert; been busy collecting evidence of a bonafide marriage, and I can't remember anymore if both still need this - would you be so kind in advising? I'm going to get my UAE police cert this week, but debating whether getting it too early before we can submit our application would be a problem - i.e. validity....

If you file on paper then it needs a signature - can be a scanned copy.

8. Part 6. Petitioner’s Statement, Contact Information, Declaration, and Signature. Select the appropriate box to indicate whether you read this petition yourself or whether you had an interpreter assist you. If someone assisted you in completing the petition, select the box indicating that you used a preparer. Further, you must sign and date your petition and provide your daytime telephone number, mobile telephone number (if any), and email address (if any). Every petition MUST contain the signature of the petitioner (or parent or legal guardian, if applicable). A stamped or typewritten name in place of a signature is not acceptable.

Online - I beleive that you type the name in the signature line.

Hi! 

I would double check on the travel.state.gov page about civil docs for this! Also, if I'm not mistaken, you're currently working to submit your I-130 petition, right? It might be a bit early as it won't need to be submitted till the NVC stage. I have read they are valid for only 3 months (need to double check that info- it might be outdated). We're almost ready to submit everything to NVC but have been putting off getting it to maybe next week in order to have it valid for as long as possible.

Thank you! I didn't use an interpreter or preparer.  I just put NA in the first line of each headline.

does anyone know whether the photographs for both beneficiary and petitioner need to be attested or stamped by either the photo studio or any authority?  in Canada, we need a stamp, so just making sure!

If the beneficiary is not in the USA the I-130A does NOT need to be signed.
