  1. Hello everyone, I am new to this forum and have been doing my research on the US Immigration process, hoping to understand whether the K1 or the CR-1 (I-130) is a better option for us. All of this is separate to the COVID-19 situation and the recent Immigration Ban. Some background: Boyfriend: US citizen by birth; lives and works in Los Angeles, CA Myself (Female): naturalized Canadian Citizen (2011) (original citizenship: Pakistani - no longer valid). Born, lives and works in Dubai, United Arab Emirates. We have been dating for about a year now (we met in LA while I was on vacation) and we are planning on getting married ASAP to live in LA. We see each other once a month either in the US or in other parts of the world (minus during the COVID-19 period). We were last together in Feb 2020 in LA. We aren't picky on where in the world we get married, as long as we are able to live together in LA as soon as possible, with the possibility of me working in the US sooner rather than later. I have a steady job in Dubai, and would not like to quit and move just to 'wait around' for the right to work, hence, the need to be able to work is crucial. If we were to categorize, priorities are as follows: 1) working in the US sooner rather than later 2) being together full-time 3) funds. i.e. OK to proceed with a process that allows me to work sooner than later, but which could take longer to enable me living there full-time (as long as we can continue our once a month visits globally - separate to COVID) vs. something that allows me to move quicker, but idle in terms of work. I have seen the below advice floating around on other topics within this forum. Is a lawyer recommended for either of these processes, or are these manageable on our own? It seems that the CR-1 option is better for us, however, once I apply, am I allowed in the US as a visitor just to meet him? Or do I need to wait until approval of this process? How long does the CR-1 usually take? Does my living/citizenship arrangement make it more complicated? If we decide on the K-1 route, how soon can I receive the EAD to work? (I know the below has timing guidelines, but we all know these aren't always the reality!) Thank you so much! I know this post is lengthy/detailed, but makes it easier to have the facts laid out to navigate the process!

  3. Hi everyone!! I was just wondering if anyone had any experience with a K1 interview after having F1 (student visa/s) denied? I have had a couple of J visas approved and worked as a camp counsellor (where I met my fiance) in 2014 2015 and 2016, and was an Au Pair in his city for 18 months. Then in December 2018 I applied for a student visa and was denied under 214(b). I reapplied a few weeks later and took more evidence with me but unfortunately was denied again for the same reason 214(b) for lack of home ties. We have now been doing long distance for over a year and have just applied for our K1 visa. We have been dating for 4 years and have tons and tons of evidence of trips, with each others family etc, but we are nervous if at the interview I am asked about my prior student visa denials. Has anyone had any experience with this and if so, what were you asked during the interview and was it an issue for you? Thank you!!!
  4. Hello all, I am trying to gather all required supporting documents to file my k1 visa for my fiancee from the Philippines. I was adopted from South Korea and I am a legal US citizen and so are my parents. I also got my name legally changed to my now-English name from my original Korean name. What documents will I need to show proof of citizenship? Also, should the kvisa form and supporting documents be printed in black and white or color ink? Anything helps!!
  5. I am a permanent resident of Canada but originally from India. I had my K-1 visa interview at US consulate Montreal after 11 months of waiting on July 24, 2019. I came to Canada about 4 years 8 months ago as a student. I did my masters in engineering here in Canada and I have been working for almost two years in an automotive company. Overall interview process was pretty smooth, surprisingly the outcome wasn’t as I was expecting. Interviewer asked me a few questions related to me and my fiancé but tons of question on when and how I came to canada, How old I was when I came to Canada, What program did I study and what kind of work I did in the past or still do, she also asked if I had a copy of my resume, luckily I had one with me. Officer kept the copy of my resume and told me that they were going to refuse my visa as they want additional information. Upon asking what kind of information, I was told that you will receive a form and you will have to answer few questions. later that evening I received an email from the consulate asking for up to date resume with exact dates of start and end dates of my school and jobs I have done. they returned my passport and my case has been put under administrative processing. I had a B1/B2 visa aon my passport, officer cancelled it as well. Stamp says (Cancelled without Prejudice) Can anyone tell if this is a typical case? Even though I forwarded my resume with all the detailed but I am not sure what caused this
  6. Hi everyone Yesterday i sent my packet 3 to the embassy as my interview date will be on September 15th Along with packet we sent some pictures together and a short story of what happened in our relationship during the time we filed for the visa and also mentioning the small family celebration we had when his family came to visit me and my family here in Egypt Actually we were totally against this idea but our lawyer insisted on sending it saying that he did this so many times before What happened is that i received a call today from Egypt's embassy An Egyptian lady called and she asked me couple of questions about when was the last time he came to visit and where did we go and what are the exact dates But she started the questionnaire with the word husband not fiance and i corrected her saying that he is my fiance not my husband Since i hang up with her i felt so nervous cause the way she was talking it was like she's suspecting that we're married I just want to know has anyone here ever encountered this before with egypt's embassy? And Should i be worried about this call? Thanks in advance
  7. Hi all! My boyfriend and I intend to get married and he would like to move to the US once we do. I've been reading up on the whole immigration process and my main concern is the public charge part. In the past (a couple of years ago), my boyfriend has dealt with severe anxiety to the point he could not work so he needed welfare in his home country. I understand that certain physical and mental health conditions as well as welfare usage are be negative factors when officers are determining whether to approve you or not. I make a little about 230% over the poverty level for our household size, so I do make enough to cover both of us but I'm worried that the severity of his past would still make him likely to be denied. Do any of y'all have any insight on how heavily that would be considered? If he did get denied, I would want to move to his country (NL) instead. Would his denial here affect anything when I'd try to move there? (Aside from anything that didnt meet their own rules of course, but would the denial specifically have any effect? - I dont see why it would but may as well ask!)
  8. I just want to double check: can my Canadian fiance visit me while our K-1 Visa is awaiting approval? We just received notice of the NOA1. Fingers crossed for your responses and advise. Cheers,
  9. Hello, we scheduled our interview in Kiev, Ukraine and have all the required documents and were wondering if we should make an updated letter of intent to marry? I read that an updated one is needed to bring to the interview. Thank you!
