Once you are denied based on fraud marriage, you will not be able to AOS regardless of whom you remarry.

Far too little information to come to a definitive conclusion. We are in a VJ discovery phase.

I don't think it is a good idea to refile at this time. After failing the first AOS interview, and getting married in six weeks will raise a red flag here. 

It is very hard to prove to officier that you were married in good faith rather than just a green card marriage..

Interesting, to me it feels like introducing your spouse as your First Wife. Technically correct but does not go down well.

Like WOW you were married 13 months before divorce and now a lawyer suggest remarry anybody to stay. How will that work.
More than likely with the way court is going you may get a delay or arrested at court and detained till they can deport you.

I mean you married someone that was caught in a lie, they are calling you a fraudulent marriage so marrying someone else in less than a years time just looks like green card marriage.

If you had applied for a green card in the past based on your marriage to a U.S. citizen or lawful permanent resident, and that application was denied, it will be important to review the reasons for the denial before filing a new marriage-based green card application.

This story is WAY to one sided.  You 'husband' lied about the living situation?  Um, did YOU not know the living situation?  Or did you just hope to cruise the the interview but the CO found posts showing a fake marriage?

 

Why are all the VJ's consoling someone who knew they were in a sham marriage but just wants a green card???

 

You spoke to your lawyer AFTER the divorce?  lol wut?  You didn't think that your MARRIAGE based green card would need, you know, a MARRIAGE?

 

This post stinks to high heavens.  If this isn't a textbook case of marriage fraud then VJ needs to close its door.
