I didnt mean the congressman, I mean ombudsman. I heard about it from my lawyer, filed it online and sent a mail, because they say VAWA must be in physical mail. But judging by how fast they responded the online request worked. Anyways, just read online about it, see if that's something you may wanna consider doing.

also: I have a lawyer and all my mail goes to his address. For this request (prima facie) and the next ones for example EAD renewal can I put my address on the letter/form to receive the documents in my house?

Thank you Sandra and others for your responses. But when that count down on the security check starts? My case has been pending already for 3 years. Could they have started it a couple of days ago and I will have to wait another 3 years? At what point they start it, any clue, anyone?

Family, can you help me how I can translate a document and then send it to USCIS? My birth certificate is bilingual, it has both English and my native language on each side. It has accepted it before as well when I filed my I485 through my ex-wife. Should I submit the same one or use a translator?

Currently, the case is pending routine security checks.Β  Unfortunately, USCIS is not able to determine when this review process will be completed.

We realize that your constituent may feel frustrated by delays related to his or her case.Β  USCIS must weigh individual inconvenience against the broader concerns of public safety and national security.
You may wish to follow up with our office periodically on the status of the case." But I never received the answer on it, no matter how hard I tried. They answered only to the Congressman.

When I look now at myUSCIS online, it says:

Next upcoming event
We will assign your case to an officer. We will review your case and mail you our decision. If we need more information, we will notify you.

And when I look at cases online, it says:

Correspondence Was Received And USCIS Is Reviewing It

On January 22, 2020, we received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number EACXXXXXXXXXX. We are reviewing your correspondence, and will send you a notice if we need something from you.

I have several questions in this regard:

1 How long this so called background check could take? 3 years? 5 years? 10 years? My case has been pending for more than 3 years and since they must make the background check for any immigrant petition, is it not beyond all deadlines for the background check?
2 Is my case beyond the processing time and if so, can I request that it adjudicated immediately or do I have to just passively wait for the outcome?
3 If it was kind of mistakenly approved, can I still be certain that if the background check won't find anything, I will be approved?
4 Can I actually ask the Congressman again to injure the USCIS why my I-360 is beyond processing times and why (since I filed in 2017) my background check has been taking more than 3 years?
5 Is it possible to file that writ of mandamus without a lawyer since I cannot afford it?
6 Where should I count my background check from - from the time of filing my case or from the moment they received myΒ RFEΒ or from the moment they saw the mistake on the approval of my case?

As to me to say that my life is in ruin means to say nothing of what I have to deal with. I am male, in my fifties and I have absolutely clean criminal record. That background check the USCIS is talking about is just the cover for their mismanagement and reluctance to follow the laws they've enacted themselves, in my opinion. Can you imagine being absolutely certain that you have been approved and then 6 months later discover through the Congressman that there was a mistake? No apology, no intention to expedite the case due to their own mismanagement. 3 years of waiting every day to be denied and deported or approved is too much for any human being. More then 3 years of background check, are they serious? Please, tell me what can I do under the circumstances?

You can sue them , take them to court , you will most likely be approved the same day.

I just want to share what I submitted for prove of sharing spouse my abusive spouse on my wawa packet. Do you guys think that this is a weak proves? Our bills used to come separate. I have never thought putting our bills on both names. do you think that they can deny or they may ask more proff of residency?
