Starting a new thread is a joy, because it means even more happy announcements of progress and approvals. Β I look forward to reading yours!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Dear Sandra or anyone, I need your help.

In 2016 I filed I-485 based on I-130, but in a year I had to file I-360 and asked USCIS to hold I-485 in abeyance. After that the USCIS website had the following notes:

10/16/2017 - We received your case

08/23/2019 - We received your response to our Request for Evidence for your Form I-360, Our Vermont Service Center office is working on your case again.

09/09/2019 - We approved your Form I-360.

It's been 6 months after that "approval," but I have never received the Approval Notice and or Deferred Action Notice.

Then I decided to contact the Congressman to inquire about my case. That is what he got for a reply from USCIS:

β€œThank you for sending our office your inquiry on behalf of your constituent, in regards to Petition for Amerasian, Widow(er), or Special Immigrant (Form I-360), Receipt Number EAC...

Β After a review of the record, it appears an incorrect system update was made on September 9, 2019, that update was cancelled, this would be why the constituent did not receive a notice.Β  Therefore, the case is still pending. Currently, the case is pending routine security checks.Β  Unfortunately, USCIS is not able to determine when this review process will be completed.

We realize that your constituent may feel frustrated by delays related to his or her case.Β  USCIS must weigh individual inconvenience against the broader concerns of public safety and national security.
You may wish to follow up with our office periodically on the status of the case." But I never received the answer on it, no matter how hard I tried. They answered only to the Congressman.

When I look now at myUSCIS online, it says:
Next Steps
Next upcoming event
We will assign your case to an officer. We will review your case and mail you our decision. If we need more information, we will notify you.

And when I look at cases online, it says:

Correspondence Was Received And USCIS Is Reviewing It

On January 22, 2020, we received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number EACXXXXXXXXXX. We are reviewing your correspondence, and will send you a notice if we need something from you.

I have several questions in this regard:

1 How long this so called background check could take? 3 years? 5 years? 10 years? My case has been pending for more than 3 years and since they must make the background check for any immigrant petition, is it not beyond all deadlines for the background check?
2 Is my case beyond the processing time and if so, can I request that it adjudicated immediately or do I have to just passively wait for the outcome?
3 If it was kind of mistakenly approved, can I still be certain that if the background check won't find anything, I will be approved?
4 Can I actually ask the Congressman again to injure the USCIS why my I-360 is beyond processing times and why (since I filed in 2017) my background check has been taking more than 3 years?
5 Is it possible to file that writ of mandamus without a lawyer since I cannot afford it?
6 Where should I count my background check from - from the time of filing my case or from the moment they received myΒ RFEΒ or from the moment they saw the mistake on the approval of my case?

As to me to say that my life is in ruin means to say nothing of what I have to deal with. I am male, in my fifties and I have absolutely clean criminal record. That background check the USCIS is talking about is just the cover for their mismanagement and reluctance to follow the laws they've enacted themselves, in my opinion. Can you imagine being absolutely certain that you have been approved and then 6 months later discover through the Congressman that there was a mistake? No apology, no intention to expedite the case due to their own mismanagement. 3 years of waiting every day to be denied and deported or approved is too much for any human being. More then 3 years of background check, are they serious? Please, tell me what can I do under the circumstances?

Thank you, I would appreciate any answer

Wow that is really messed up. I cant answer all of your questions, but an advice I would give - file an ombudsman inquiry. My case was approved a few days after I filed one, and you definitely seem to qualify.Β

Hello everyone,

Β

Hope all is well. Can @sandrajΒ or anyone else advise if a J1 visa holder is subject to the two-year home residency requirement whenΒ filing AOS based on VAWA? Is the 2 year rule automatically waived orΒ do I need a waiver before applying for AOS?

Β

Before my husband and I separated,Β I submitted an I-601 waiver based on severe economic hardship to my child and husband who are US citizens with the intent ofΒ doing an AOS caseΒ Β based on our marriage. We are now separated and I have filed my I-360, however I recently got an RFE for the I-601 waiver asking for my husband's financial records, and more proof to substantiate the hardship claims. Since I no longer have any access to his information and he would not be a part of the I-601 moving forward, how do I respond to the RFE? Should I abandon it altogether or will I still need a waiver with VAWA? Any assistance would be greatly appreciated.

Β

Thanks
