I filed it and received no answer.

Ah that's no good. Did you do it online or physical mail? Try again and do both.

Hi, Shroy,

C31 get those, who's filed concurrently 2 petitions and been aporoved. My I-130 based I-485 was filed a year before I-360, so I am expecting my 4th c09 permit.

I know that. I asked that question because before approval status, we receive new card is being produces status update which means vawa has been approved and we will receive c31 EAD. If you haven't seen that status and witnessed approval status instead, it might be a system glitchย

Dear Sandra or anyone, I need your help.

In 2016 I filed I-485 based on I-130, but in a year I had to file I-360 and asked USCIS to hold I-485 in abeyance. After that the USCIS website had the following notes:

10/16/2017 - We received your case

08/23/2019 - We received your response to our Request for Evidence for your Form I-360, Our Vermont Service Center office is working on your case again.

09/09/2019 - We approved your Form I-360.

It's been 6 months after that "approval," but I have never received the Approval Notice and or Deferred Action Notice.

Then I decided to contact the Congressman to inquire about my case. That is what he got for a reply from USCIS:

โ€œThank you for sending our office your inquiry on behalf of your constituent, in regards to Petition for Amerasian, Widow(er), or Special Immigrant (Form I-360), Receipt Number EAC...

ย After a review of the record, it appears an incorrect system update was made on September 9, 2019, that update was cancelled, this would be why the constituent did not receive a notice.ย  Therefore, the case is still pending. Currently, the case is pending routine security checks.ย  Unfortunately, USCIS is not able to determine when this review process will be completed.

We realize that your constituent may feel frustrated by delays related to his or her case.ย  USCIS must weigh individual inconvenience against the broader concerns of public safety and national security.
You may wish to follow up with our office periodically on the status of the case." But I never received the answer on it, no matter how hard I tried. They answered only to the Congressman.

When I look now at myUSCIS online, it says:
Next Steps
Next upcoming event
We will assign your case to an officer. We will review your case and mail you our decision. If we need more information, we will notify you.

And when I look at cases online, it says:

Correspondence Was Received And USCIS Is Reviewing It

On January 22, 2020, we received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, Receipt Number EACXXXXXXXXXX. We are reviewing your correspondence, and will send you a notice if we need something from you.

I have several questions in this regard:

1 How long this so called background check could take? 3 years? 5 years? 10 years? My case has been pending for more than 3 years and since they must make the background check for any immigrant petition, is it not beyond all deadlines for the background check?
2 Is my case beyond the processing time and if so, can I request that it adjudicated immediately or do I have to just passively wait for the outcome?
3 If it was kind of mistakenly approved, can I still be certain that if the background check won't find anything, I will be approved?
4 Can I actually ask the Congressman again to injure the USCIS why my I-360 is beyond processing times and why (since I filed in 2017) my background check has been taking more than 3 years?
5 Is it possible to file that writ of mandamus without a lawyer since I cannot afford it?
6 Where should I count my background check from - from the time of filing my case or from the moment they received myย RFEย or from the moment they saw the mistake on the approval of my case?

As to me to say that my life is in ruin means to say nothing of what I have to deal with. I am male, in my fifties and I have absolutely clean criminal record. That background check the USCIS is talking about is just the cover for their mismanagement and reluctance to follow the laws they've enacted themselves, in my opinion. Can you imagine being absolutely certain that you have been approved and then 6 months later discover through the Congressman that there was a mistake? No apology, no intention to expedite the case due to their own mismanagement. 3 years of waiting every day to be denied and deported or approved is too much for any human being. More then 3 years of background check, are they serious? Please, tell me what can I do under the circumstances?

Thank you, I would appreciate any answer

The background check can take a few months or 1 orย 2 years, but I saw a few cases that took 3 years.ย Nobody can say if your VAWAย will be approved or not, but there is a chance the officer approved your case before the background was completed and he/she realized that and the officer canceled the approval. The congressperson should notย inquire at least before 180 days pass.

ย

I don't advise you to file a writ of mandamus without an attorney,ย it's very difficult. You count the background when is completed, that is it.

DANI T you asked one question on the VAWA thread part 17. You won't be able to get any information aboutย your AOS ย online or over the phone. I had some work permits and AP ย renewed within 10 /30 days days, and I had other cases ย awaiting for 8 months to be issued the EAD and AP.You can go to info pass but the most they can do is to submit an inquire on your behalf.
