Timeline

Hey ALL,

 

as you know getting a SSN for a K1 is literally the worst thing ever. We've gone to the SSN office three times now and they still haven't been able to issue a SSN to my now spouse for whatever reason...which they won't tell us. Anyway I wanted to know as tax season is coming up should I apply for an ITIN? And do I need to do that while his visa is still valid?

SSN was the easiest part for me. Applied after 2 days of arriving, got the card 3 weeks later.

 

As a K1. You must apply for SSN with your single name and within the first 74 days of your i-94.

 

To apply for ITIN, you will need a letter from SS officer stating you're not eligible for SSN (which technically you are). So you might not be able to get it.

I don’t know what’s going on with our case and social security. We’ve been trying for 2 months now 🙃

If youve followed the procedures as outlined by the thousands of SSN posts here and the remedies provided, you should have been able.

Do you want help with that or are you just grumbling under your breath?

If you do, tell us what you've tried to do, how long they have been in the US, when you went, what name you applied in (ie. actual details) and QUICKLY as 2 months equals 60 days and you have to apply and be processed by day 76.

Or not, and carry on.

We went into the SSN office a week after arrival and were told we should hear back something within 4 weeks.

We didn't. I contact the DHS and they directed me to give the SSN office a call which I did the lady on the phone picked up and stated that they needed to reverify VIA SAVE in which she did and there was another inquiry via SAVE from SSN. This puts me at about 6 weeks. We waited another 2 weeks and called SSN office again only to be told that he was denied a SSN and no reason was given.

We went into the SNN office last week were applied AGAIN for the third time for a SSN for him and now we are waiting. She said to return back after 4 weeks if we don't hear anything but by then his K1 visa would be expired. So what would you advise?

If still within the original 76 days from entry, you can try again with the SSA. Have them call the verification number noted here:

I did do that! The officer chose to ignore us and said that she knows what she is doing and continued with handing us a letter and reference number. Should I just go to another SSN office and reapply before the 76 days?

Unfortunately, it sounds like you got a bad apple. Sorry to hear.

Another office may be helpful. No guarantees, obviously.

 

The issue with filing for an ITIN while still in status is that the IRS cannot issue an ITIN for somebody who qualifies for an SSN. So that's a bit of a catch-22.

If filing taxes after the 90 days of legal status (still file AOS,, though!), getting an ITIN is more likely IMO.

Bad apple indeed! I guess i'll just have to wait it out. 90 days will be soon.

Nothing more you can do but hope for the best.

The timeline to checkup is 3 weeks not 4. Id GO IN PERSON then. Not call.

PS if you were already denied you should have received a denial letter. If you didnt, demand one for the ITIN application.

we are in the same spot, checked in at the SS office in person multiple times and followed the steps here but had your same result. Just depends who you are dealing with I think. We are now in the AOS phase and plan on applying for the ITIN. I called H&R block and they will help do that application and file your taxes so I think I am going to go with that.

It really is who you deal with.  We applied for my wife's SSN after we got married which can be tricky.  Lady at the SSN office in Iowa was nice enough to submit for a SSN in my wife's original name followed by a request for name change to her married name.

You can manually file your taxes and, if you haven't gotten the SSN, request an ITN. 

 

We had an issue getting Mary's SSN but then tried another office and got it in a week.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail
