You should have DCF'd her at the same time as your wife.   Now you need to do another I-130 and she waits it out.  Her chances of coming on a tourist visa are slim since her mother is immigrating.

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Who knows? Like so many in ncountries like Thailand and the Philippines, teen-0age girls have sex with teen-age boys, give birth and the father disappears...forever

Except Philippines is clear about custody for children born out of wedlock,  what about Thailand?

I’m only left asking if there is no father why wasnt the child’s case filed jointly with  wife’s? The child has obviously been in the picture for a while...

 

you’ll need to prove child’s father has passed... if he’s still alive approval from him will be required

Seems strange that a minor child with only one parent would not be petitioned with her parent if the plan is for her to continue to live with her mother.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

First of all, there are no plans to bring her daughter to the states to live with us. I am on ly asking if in the future, she wants to visit us, what are her options and how long could she stay,, to attend college, for example.  if she decided to live here .This is a hypothetical, not a need to know now question. Had she indicated she wanted to come here, of course I would have included her in the I-130.

If she wants to visit, she can apply for a tourist (B-2) visa.

If she wants to study, she can apply for a student (F-1) visa.

Both of the above will require showing ties to return home, which can be difficult with close family members living in the US.

 

If she wants to immigrate, you petition for her then she applies for a IR-2/CR-2 visa (if under 21 and unmarried), FB-1 visa (if 21+ and unmarried), or FB-3 visa (if married).

The specific type of visa isn't something she has to worry about...it will be classified into the appropriate category if/when that time comes.

Wait times are several years for FB-1 and almost double that for FB-3.

 

She should have been included in the I-130 either way. The form does not ask about only children immigrating.
