HOW MUCH PROOF IS ENOUGH?

Hello!

 

My fiance and I are trying to determine if we should get a lawyer or use a service like, Rapid Visa to help us navigate the K-1 visa process to ensure no RFE and/or any delays. Obviously, we would rather save money but are willing to pay a premium to ensure us being together sooner than later. This is coming for the stress of wanting to fill out this form and submit enough information without delaying the process or royally screwing it up.

 

How much is enough proof to submit?

 

  • 25 pages outlining highlights of our chat history over the past year knowing each other
  • 5 pages sampling our call history via FB messenger
  • 120 photos
  • engagement ring receipt
  • engagement part invitations that were sent out at pictures (part of the 120 photos)
  • Flight Receipts
  • Email from his parents congratulating and reaching out to me to say hello
  • A spreadsheet beginning our planning of wedding (no date is selected because it's completely contingent of immigration approving the visa and then we can choose a date)
  • Wedding Dress Shopping Confirmation Emails
  • Receipt of a few dates we went on w/ pictures (again, part of that 120)

 

Do we need to write a letter of how we met? How in depth does that need to be?

Do the letters of intents from both of us need to be wet signatures?

Is it normal to have a lot of blanks on the I-129F form? What blanks should we put "none" in?

When adding additional information, how do you decide what the item number is? For an example, when adding in previous addresses? 

How exact do the dates of living at those said addresses need to be?

 

I read submitting too much is reason for denial and of course that is something we don't want to happen. 

 

I appreciate the feedback and any help we receive!

Most of what you listed is not needed for the petition.   For  the petition,  you need to prove face to face meeting.  Emails, chats, spreadsheet, dress shopping doesn't do it. 

 

I don't see boarding passes,  passport entry stamps.

 

Circumstances of meeting should be able to fit on the space provided on the form.  They are not interested in an in depth love letter

 

Photos do not have much utilitarian value.   120 is overkill .  Many have had petitions approved with zero photos. 

 

All evidence submitted to the USCIS is to be legible photocopies.  The only "wet" signature required is on the petition form itself

and 120 photos is way too many

25  or 30 is plenty

 

You can do all yourself

seen too many posts on here where  a lawyer and Rapid Visa messed up the process

You don't need to prove intent to marry beyond the statement.   My petition consisted of the petition form and 7 additional pieces of paper.   No pictures,  chats, emails,  spreadsheets,  wedding plans.   Nothing  .

If your case is straightforward, save your money for lawyer and spend it for moving expenses and life when AOS is pending instead. In fact, if you haven't filed K1 visa yet, I personally suggest you to file for CR1, esp since you're from ESTA country and can visit each other with no problem. Read the guide from VJ and you can do it on your own. Good luck!

You write the number of the original question. If you want to provide more Information on section 1, number 2 then that's what you use

It looks like for the CR1, we would need to be married. Which we aren't, yet. From your perspective, why would this potentially be a better option?

Seach on VJ how many members think CR1 is better than K1 esp for those who can visit each other. AOS process now takes longer. I saw some people from October 2018 were still waiting to get EAD/AP with no AOS interview in sight.

Dude, please don't send all that extra stuff.  That poor person at the CSC who has to wade through it all!  Plus, I suspect that it delays the processing of your petition.

 

The requirements for an approved petition are so simple:  1) One of the two is a USC.  2) The two have met in person during the immediate prior two years, 3) Both are legally free and intending to marry one another within 90 days of the alien fiance's entry into the US.  That's it.  More may be required at high-fraud/high-risk consulates, but certainly not for Sydney.

 

Follow the instructions/checklist available on the USCIS website.  The best evidence of the one required meeting in two years prior is passport stamps and boarding passes.

 

Suggest you both become members of VJ and read as much as possible to learn about the various stages of the process so you can avoid pitfalls along the way.  Good luck!

 

As this is a DIY site, the vast majority of us have not used lawyers or agencies such as RapidVisa.  Save your money for the AOS fees.

Also not necessary for petition approval.  We didn't send any.  Photos are secondary evidence, meaning that they are less useful when it comes to demonstrating having met the in-person meeting requirement.

 

The only photos required for the petition are the 2x2 passport style photos.

With my 130 spouse petition for my husband, our attorney did not include any of the items you listed and we DID received an RFE for proof of bonafide marriage after pending for 11 months. I sent them 476 pages of evidence. So, in my opinion, things have gotten stricter in regards to evidence of relationship. It doesn’t hurt to send what you have. If this evidence would have been sent with our petition, we wouldn’t have had to wait so long for approval. Send it all.

I130 is a different petition with different requirements.   Don't compare the two
