k1 Visa procedure after arriving the us

Timeline

 

 

I arrived on the 12th which is 6working today and we want to do our wedding ceremony in 2days time. I was just told it may be too early and it may affect my process on the adjustment of status procedure for k1. 

Please, I will like to know if its advisable to get married right away or should I wait for some more days. And how long?

Marry and file for AOS a soon as possible.

 

There is no rule stating you have to wait; on the contrary, you just have 90 days from the date of entry to marry and file for adjustment of status.

You don't have to wait for any specific period of time for the K-1. It is recommended to apply for a SSN prior to marriage. Your state may have a wait time for their marriage license, but it is for everyone and not related to the K-1.

Thank you so much. 

 

I went to the marriage court for the marriage license. I got the license today also and was told I can come back in 2days for the ceremony. It's a walk in appointment. 

 

On my way back, someone called and said her niece had issues because she got married right away she didn't wait for up to a month on her arrival so I got confused .

There is no such thing as marrying too early after arriving via a K-1...........

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I arrived July 4th, got married July 11th in our living room and sent AOS/EAD/AP on the July 17th. The sooner the better because the processing time for those three takes too long. And We did that also so we can focus on enjoying our marriage and worrying about paper work anymore. Also because of my medical so it doesn't expire.

What does the date of medical have to do with the date of the wedding?  I thought you only had to enter the USA before expiration date of medical, do you have to marry before then too?

No you do not have to marry before that expires .. if you don’t apply for AOS within 1 year if the k1 medical date  ( ??? this is the correct time frame I think ) , then you have to do another medical. So timely filing is good for all sorts of reasons. 

But make sure you apply fir your SSN .. in person at the SSA office ... before you marry otherwise you will have to wait until you get the EAD in hand. Print off your I 94 from the CBP page and take that plus your passport to the SSA office

No but your medical should still be valid before sending in your AOS, if not you have to get a civil surgeon in your area in US do it again or you'll get RFE later in the process and I didn't want to go thru that process again. Also I did my medical in March and my visa wasn't issued till July, I wasn't sure if medical expires in 6 months or a year after the date I completed it or the day I arrived to US. Is just one of the things we considered and why we sent our AOS asap.

We got married four days after my wife's POE arrival. In Washington state, there is a 3-day waiting period after purchasing the marriage license. Though processing times are now somewhat prolonged, take a look at our timeline for AOS processing for a K1 and K2 visa with interview.

 

The sooner you get married the sooner you can start getting your affairs, and documents in order to file AOS/EAD/AP, the better! :whistle: I mention and recommend all three applications, because when concurrently filed,, the fees for EAD and AP are waived. See Special Instructions tab on USCIS I-485 link for more information: https://www.uscis.gov/i-485 .

 

Suggest that you review the VJ K1 visa Flowchart, for a good schema of things to do and when to do it:  https://www.visajourney.com/content/k1flow/ . This holds particularly true for SSN, if done in the wrong sequence, it can take months for get the SSN.

 

Tell the person you were getting the less than accurate K1 visa information from to go fly a kite.
