i -130 Filers of Parents for July 2019

When did you send I130 for your mother? I filed I130 for my parents on March 08, 2020 and havent heard anything from USCIS yet (except of receipt). I read many comments here and felt sad since they said that I-130 for parents wont be processed till next year 2021. I'm not sure where they got that news and whether it's true or not?

Sorry for late response, I applied in 8/2019 and got approved in 3/2020. Since my mother got stuck in Australia due to Pandemic. we have not submitted any documents yet and our application said expired in 3/2021. Hopefully things will get better soon, Good luck to all of us.

No derivative allowed with IR/CR visa. After your mom immigrate to US, she can petition for her child( if she still not married). In fact, you can petition for your sister right now, but it will taking longer.

Trump is president until Jan 20, 2021.  Until that date, he can extend the ban well past his term and force President Biden to rescind the ban.  Last time, he waited until the last minute to extend the ban.  Don't get your hopes up until Trump is no longer president.

What is your plan for covering all her medical expenses?  She won't be eligible for medicare.

No, she won’t. Marketplace insurance is my first option. The second option is to add her to my employer insurance (must be able to claim her as dependent in my tax return), which would be hard to do for 2021. But 2022 should be possible, provided the health plan rule doesn’t change ... they’re all getting less generous than it used to be.

I have never seen a workplace plan that allowed you to add elderly parents.   Most insurance only allows you to cover dependent children up to age 26.

 

It is critical you have a solid plan in place to overcome the public charge.  86 is quite old, and it is likely she will need to make use of lots of expensive health care resources in the US.

Thanks. I checked the marketplace insurance option (and I know that, that is available for recent LPRs), and for that age, the premiums for 2020 started around $600 to $800 per month. At what stage do I have to sign up for this - prior to the Consulate interview? Or when the application goes to NVC?

Not having lived here long enough and not having paid Medicare taxes for the required 10 years. They will be able to get part Medicare by paying premiums after 5 years of permanent residence but it won’t be full coverage. https://www.hhs.gov/answers/medicare-and-medicaid/who-is-elibible-for-medicare/index.html
