K-1 and petitioner truck driver

Hello guys!

Help me please if you can with my situation.

We already received NOA-2 few weeks ago.

My fiance is truck driver with his own LLC. He wants to quit this job when I'll come to USA so we can be together every day. Now the question: what should I say on interview? Admit that he's planning to change job? Work on the same place for few month after I'll come? I'm afraid that person on interview will not like the fact that soon my fiance will have no job...

So what do you think he should do? Don't quit till filling for AOS?  Quit now and find a new job (this will not be a problem but less money comparing to truck driving)? I'm so confused 😥

It’s hard to say without knowing specifics but if his income qualifies on his own, why complicate things and quit? Better guarantee you have your green card first and then go from there

He wants to quit truck driving because he'll never be home if he'll stay. I don't want this too because I want to come to USA to be with my future husband that I love and not be alone while he is driving somewhere 😔 Thank you for your replies! I really need help.

Hi @AlenaS,  i think what @p-ana try  to say is, if your fiance quit his job right now, does he still can afford and qualified to be your sponsor for AOS? You and your fiance should think about it in advance before take any decision about the job. If his income is not enough when applying for aos, he must thinking for anyone that can be your co sponsor. I dont think its necessary to mention something that you still not sure on interview, just focus what happens right now.

No one here can advise you on your personal financial circumstances. If he can afford to quit and doesn’t want to drive a truck anymore, then why not quit? He does realize that you won’t be able to work for many months after your arrival, I hope. 

 

One thing we can advise on is how you answer questions. There is only one answer to give when questioned by anyone in the immigration process - the truth. If he has quit his job and is unemployed when you have your interview and you are asked what work he does, you must tell the truth that he’s unemployed. This is a free country and it’s not illegal to be unemployed. Nothing wrong with quitting a job. There’s everything wrong with lying or distorting facts in this process.

We don't know his income or assets, so we can't answer.  I sure the petitioner knows his financial situation.

 

I quit working for about one year when my Fiance first came to the USA so I could help her adjust to the USA, I just used my assets on the AOS and had no issues.

Agreed with @JFH above.

 

You and your fiancé must figure out the financial aspect of immigration.  If he can quit and still qualify as sponsor, that’s great.  If not, you’d have to find a co-sponsor.  Other option would be him finding a job with less invasive hours than the trucking industry presents.

 

The MOST important thing, is making sure you don’t lie.  If he’s unemployed, you must be truthful about it.

I'm not planning to lie at all. We are not sure about anything right now. So basically we'll be fine for interview with what we have now?

What country are you coming from?

 

I have been to a couple of K1 interviews, never had the CO start asking about my job or the what I planned on doing in the future.

He'll definitely will not be unemployed by interview. I was just wondering if CO asks me something about his work (like how I will feel about my future husband being away from me all the time for example) should I tell him/her that he's planning to change job.

1. AoS is not the end of your story and just the beginning. Poverty line is not family budget, it is simply the minimum threshold which shall be observed at all times but it is not the amount a family will be comfortable with. You two must be very sure how you will provide for your living, before, after AoS and further on. Having money issues is very much likely to ruin a relationship. Even more, owning and managing a business is no better than driving a truck. He will still suffer all the pressure and strain, at home and with you by his side.

 

2. The Kiev embassy is not interested in how you will happily live ever after. They are pretty much straightforward and look at facts as laid out in the petition. They took my fiance's I-134 and never cared to look into supporting documents, which were returned immediately. They did not ask me anything about his job, or his future plans. You must be and sound pretty confident about your relationship and you will be fine. To be so please see above.

For AOS you have to show at least 6 months at a new job, so if he was to change jobs that’d delay filing for AOS until he can show 6 months at the new job or you’ll need a joint sponsor.
