Yeah, I can imagine the enormous pile of the file now..... How can I mail in the giant file now? I used file envelope and certified mail last time. This time, I don't think the envelope can fit the thick file..... Can I use a box?! 

 

I will mail in after I come back from China. I come back on Mar 2.

Sending 8 consecutive months' worth of statements out of a 4-year period was a definite mistake.

Makes it look like you only co-mingled for those 8 months.

The usual advice is sending one statement per quarter for the whole time period you held the account/whole time of marriage or just sending every statement for the whole time period...

It doesn't need to be EVERY statement from 2014 until now.

Send in statements  for one quarter a year, for each year. So January, April, August, and Nov. Something like that. But all of your proof needs to be from 2014 until now, if you can't provide that then write a statement as to why you can't.


Note that what ever you sent them says that it didn't show joint use by both parties ALONG with having a short period of time available. Make sure you're both using those accounts, and you can highlight different transactions from the different cards if needed to show you both use the same account.

It also says that you didn't file your 2014 taxes. You need to do that.


It looks like ROC was taken SUPER lightly, and they did their due diligence to investigate the evidence you sent in.

I was in F1 student visa back in 2014, I don't have income, so I didn't file the tax 2014. My husband's accountant files his tax as"marriage file separately". Can I write a short statement to explain why I didn't have tax 2014?? Otherwise, I don't know how to fix this one.

Clearly, I didn't know that. I thought I just need to show them the most recent months banking statement. I didn't know I need to start from the beginning of my marriage.....

First, relax. I know it's stressful getting an RFE, but if you're legit, you will be fine.

 

Second, I'd simply prepare a response as though I were filing the I-751 for the first time -- only a bit more methodical about how you put your package together. You have a list in their letter, but you may find the link below (click the arrow) useful in thinking through the evidence you submit.

 

Relax. It's just a bump in the road. You've got this.

Yes.

You simply have to write a statement saying that in 2014 you did not have any income and were not legally required to file taxes. Other than that there really isn't a fix since I don't think your husband can go back and file jointly. (Maybe he can amend it??)

one question.

 

We pay for the Utility bill, but the name is under my father in law and sister in law's name. I called conEdison, they have to close the current account, open a new one if I want to change to our name.  If I do so, I only gonna have one-month bill statement, which is February, shows our name because I plan to mail in the documents in March. Do you think is it necessary to switch the name at this point??

Who cares how big the file will be?  They want it...you send it.  Why would you wait?  Take a few days and get it done.

I have my board exam to prepare before I leave for China on Jan 27. So time gonna be too tie if I plan to send them in before my trip

I don't think that makes sense. Consider other viable options to show cohabitation, and explain in your cover letter why you can't send utility bills. I have a few on my list. Since you don't have much time, just try to get as many 2 or 3 star items as you can (covering the time from marriage to date) in each section in my list.

 

For instance, even though you live with your/your spouse's parents, you can make out a signed lease agreement with them for each year that shows how the utility bills will be paid. You can find simple templates online.
