Okay thank you very much. sorry for the confusion. 

She just message me right now and she is trying to returned her visa to the consulate. Do I still have to contact the USCIS to terminate it?

all you can do is contact uscis and tell them you wish to withdraw it.

 

file for divorce.

 

if shes here, not much you can do. if she wants to move here in the future and finds someone else to petition her, nothing you can do about it.

I think you as the petitioner would have to request a new one.  Once one is expired I don’t know of a process that can reactivate it.  She can’t request anything except a tourist visa.  She can’t petition her own family based visa.

What is her home country? Not all countries are treated the same when it comes to giving out visas. 

 

My suspeciom is that that she is from one of those non-visa waiver countries and realized she still wants to come to America

File for divorce.  If the visa expires and ahe didnt use it in time she cant just make it valid again.  You can also contact the consulate and let them know you are separated.

Ok so I'm not 100 percent clear on what happened here but I'm thinking you are saying she actually went through the interview at the embassy and had the visa printed in her passport. If that is not the case no real need to read on. In this case I would be curious to know exactly how much she knows about the immigration process from a standpoint of is this a scam. Because if it was a scam and you two are passed your 2 year anniversary and she did in fact use that visa to enter the US without telling you there is little left that you can do and she is most likely done with you. Now lets go over the steps of cr-1/Ir-1 and you tell us how far you got.

 

Step 1- File I-130

Step 2- send documents to the national Visa center

Step 3- she goes through the interview process at the embassy

Step 4- they print her visa and give it to her

 

How far did you get exactly?
