Freaking out! - no verification of me being here on a K1 fiancé visa?!

Hoping someone can reassure me right now...

 

I just called my local SS office to ask for an update on my application, to be told that they cant process my application anymore as theyve had manual verification come back & say im not here on a K1?! they have no confirmation of such thing?! despite the fact i have my I-94 record which states i was accepted here on a K1 when i landed on the 13th October 2018

 

Im now freaking out that we cant send off AOS?!

 

Please someone help me understand.. me & my husband are worried sick now

Ignore them, they're useless. File for AOS, EAD & AP. Once you get your EAD you can reapply for a SSN.

Calm down and don't worry ok. Go ahead and file for AOS because you came on a Legitimate visa.

Thank you for the reassurance! I just had a really rude woman from my local SS offices which doesnt help - she told me they mismatched the verification because i dont have an EAD, so i said thats correct because we got married just over a week ago & now were preparing for AOS, EAD & AP so i said how comes others got a SSN before EAD? she wouldnt let me explain my query.

You still have time left so I do not know why they did not give you a SSN. Usually you see something like this around day 70-85.

We went to the local SS offices on 29th October (10 working days after my arrival) & they took all my relevant paperwork, the lady gave me a letter with my reference number & said its currently taking 6-8 weeks.. she was kind & helpful, gave me her work email & contact number - i emailed her last week & thought id call her today, she wasnt around so i  spoke to 2 of her colleagues, the rude one & another - both saying i cant get a SSN until i have an EAD, which we all know is incorrect, just extremely frustrating & did make me panic as when the first lady said about not verified on a K1 im thinking oh god, whats going to happen with my AOS?!

Dont worry hun. You're here legally. SS was completely ignorant with my visits too. I was apparently not in their system? (Yay for multiple catholic middle names). I had to be hand verified by home security and that took almost 6 weeks. 

I think you had a person who got up at the wrong side of the bed this morning and, not being able to find you in the system, just bluntly told you they cant verify you just to make you go away.

Give it a day, try to call the woman you talked to before again and have her sort it out. 

In the meantime just go ahead and file AOS EAD and AP.  You'll be fine.

This is another example of an SSA office that... well doesn't know what to do with a K1. There's not a lot you can do for now. File your paperwork. Return when you have an EAD. Not having an SSN isn't the end of the world, and you can do most things without it, even if it's a little more of a hassle.

Im worried about not having a SSN until EAD because of medical insurance - my husband has emailed his work HR to see if i do need a SSN.. im asthmatic & i brought 3 months worth of inhalers, now im worried i wont get to see a doctor until i have an EAD.. is it worth us going back to my local SSO with the print out to show them K1 fiancé visas can get SSN?

 

Also, the USCIS SAVE record shows my case was sent back to maryland SS HQ, does this mean it’s still processing & my local office is chatting rubbish?!

By law an SSN is not required in order to obtain health insurance. I have seen some individuals on here argue that fine point with their workplace HR. Even if you sign up using the health exchange or purchase out of pocket it's not required. It may be requested later, but even then you have the right to withhold that info, as the only person who can actually request the number is the IRS.

 

I cannot say what it would be worth to do with the SSA. In general, if your I94 was fine, you should be showing up in the database and they should have no trouble understanding it. If the person has trouble understanding on the day you apply, you can show them the SSA rules printout for K1s, and demand a supervisor OR go to another SSA. In other situations (such as you not being in the database) you'd withdraw your application before it even began and show up when you were finally in the system, because if not you'd have a long wait ahead that could be screwed up. You could wait to contact the person who originally handled your case, or speak to a supervisor, but I'm not sure where in the process you are 'stuck' at. Those that need to be manually verified for whatever reason is going to take a lot of time. For us, we waited 14 days, walked in armed with the rules because I expected our small-town SSA wouldn't know how to handle things.. and was surprised. Card showed up within a week, and we updated it once he had his green card.

 

It would seem it could be worth speaking to someone higher up in the know about the case, but ultimately I'm not sure what they will do. Having an EAD should do the trick though.

File AOS without a SSN.

Pick a new office and try again on the SSN. Apply in the exact name that is on your I-94. Or go back to the same office and ask to see a supervisor. Plan to camp out all day until they let a supervisor help you. Be politely stubborn.

Going to the offices tomorrow & will ask to speak to the supervisor for sure!

 

Just figuring out how to word that i truly am eligible.. despbite having the print out showing i am from the official SS website - i couldnt get a word in edgeways on the phone

 

When filling out the AOS form, shall i leave SSN blank & tick i have applied? The SSO said nothing about withdrawing my application

Well I wouldn't bother trying to explain anything to a regular worker.  They will try to fob you off and get you to explain it all again to the underlings.  I would keep saying "I wish to see a supervisor" full stop.

 

My wife is a master of stubbornness. She worked her way up to a supervisor at the IRS  by politely saying that in response everything the guy on the phone (who wasn't comprehending the $10,000 data entry mistake they made) said to her. "The supervisor is busy and it may be two hours." "Then I will hold this phone to my ear for two hours because I need a supervisor." It took about five minutes for the supervisor to come on and about 10 seconds for her to say she saw the $10k error and would submit it for a rework."

 

Tell the supervisor you were not confident at the x-number of times others had tried to help. You've got the print out that you are eligible. You will apply exactly as the I-94 name is whether misspelled or your first and middle name are run together as one long name. You have your passport where K1 entry was noted. AOS question. I'm not familiar with a place to tick "applied for". I left mine blank---it says something like "SSN (if any)". I didn't have one.
