She said she was nervous and panic

Again....is there a difference in language?

All of those questions can easily be confused if one participant doesn’t speak English well.....

Everything can be easily explained, like "sometimes we staying in hotels, sometimes in each other's places" (it's true right?). "I forgot about the birthday gift", or "i confused this bday with another", whatever actually happened. And so on. Just send explanation back to them.

Agreed...time to lawyer up and respond to every point on the NOID clearly. A stokes interview is not common so they were likely already suspicious, and the amount of conflicting answers provided will reinforce their suspicions.

They already have a lawyer but I think they should fire her. They both speak English. She said she was tired, she left work and went straight to the interview after doing a double. Honestly I don’t know what to tell them. I was just looking here to see if I can get additional info.

Hope it's ok to tell a short story. Funny thing reminded me of horrible times with uscis the other day. My husband asked me to buy him a new toothbrush the other day. So i am in the store and i am looking at tooth brushes and i don't remember what color my toothbrush is hahaha. (because i didn't want them to be the same color). Mine! And they expect you to remember things like other person's toothbrush color. Just trying to say that I think there is no crime in getting those questions wrong, they will be ok. Eventually...

Difference between remembering toothbrush colors... which actually isn't that hard (mines white, his gray... both electric and different brands so easier).. but forgetting what you both did the day before the interview... that's kind of odd. Seems like just another waste of money on a lawyer when a lawyer can't save you from "forgetting things" during the interview. This day and age it's amazing people can't research  a little and find the answers. Google pretty much can give you anything you want and if not, it leads you in the right direction.

except they didn't get a simple question like that wrong. They got important dates and other important info wrong. All of it wrong not just one wrong but all wrong. That is the big differences.

My husband and I just went through these questions. I didn't remember we went to a restaurant for our anniversary, he did. He did not remember what I got him for his birthday, I did. He has been to my university many times, but doesn't remember the name. Married for 6 years now.

Exactly. What you both did day before the interview.. they couldn't remember 24 hours prior the being asked? I drink and I still can remember that stuff(what we did day before his biometrics as we did not have an interview)... and remember his birthday last year, anniversary (wedding and dating ones)..

Well,  we were asked about the day before the interview too and i started telling about the day before before the day of the interview, then i realized it and corrected myself. I am lucky i realized it i guess, but that's human brain. It doesn't mean the marriage is not real. Again, i don't see anything crucial here. I even think uscis doesn't (but i really don't know what they think of course), they just have to have explanation before approving.

Think it's always natural to get confused/flustered when questioned or like taking a test. This one though has a lot wrong, and adjusting from a B1/B2 visa, so scrutiny is probably higher. so add both those together and red flags start popping up.

 

Oh we both have our moments don't worry. I'm brain dead half the time(note my gif on the left below... minus the drug portion lol) and he can't structure a full English sentence haha. We still fully understand eachother though. Not about smarts or dumbs at all .

Except you would not forget where you slept or forget that you did buy your spouse a gift. 

 

Trust me I mix up days weeks and heck if I know what colour my tooth brush is. But I sure as heck know where I slept and know full well when I buy a gift for someone. I may mix up what year I bought what but I would know I did in fact get a gift. This is part of the issue here.

 

I truly do not believe they are ok and will get through this. They need a better lawyer as they  already got a letter of intent to deny. This is not just we need more info or proof this is we don't believe you are a real couple.

I was just going to say how I remember very well the restaurant we went to for our anniversary but then I realized that that was Valentine's Day! 

 

I don't actually know the color of my toothbrush, I change my toothbrushes too often to keep track. Also, my husband forgets so many small details I'm sure it's possible to mess something like this up.
