My Fiancé visa got denied !!

My Fiancé visa got denied because of my fiance's income tax is low. It supposed to be $18,000 the minimum. The embassy is requiring a sponsor's 2017 federal tax return and corresponding W-2 now, but the big issue is that his father does not want to help  nor his mother. He doesn't know anyone could help to be a sponsor.

Please help us with suggestions. What should we do ?

Just to clarify, did you get an actual denial or a request for more evidence? If it was a denial, your K1 journey is done. You can either file again for another K1 and go through the process all over, or get married and file for CR1. Now, if you weren’t denied and just asked to submit co-sponsor information, you just need a co-sponsor. Fill all forms and send with all evidence. A co-sponsor doesn’t have to be family, it can be any LPR or US citizen currently filling US taxes that is over the poverty line. The only way for you to be able to proceed with this process is to get a co-sponsor. There’s no way around it, there’s no use in trying anything else or fighting the embassy or USCIS for this. They don’t budge on this stuff. You either prove you have the money or not. You can’t appeal this.

Being a financial sponsor is a big commitment, if you can’t find someone who is willing to do this then he will have to find a way to make up the short comings either by getting a second job, getting a job that does meet the requirements, or get savings that make up for the discrepancy.

2 options:

1.  Find a sponsor.  It can be any US citizen or LPR

2.  Petitioner can add a 2nd job to boost income.

 

There really are no other options unless petitioner has assets.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As noted above...

  1. Get another job.
  2. Use assets to supplement income, if available.
  3. Find a co sponsor.

There's no other options to get the visa approved.

 

Keep in mind the potentially extensive costs coming up (wedding? AOS fees ($1225). Health insurance. Housing + food + living expenses. Not being able to work for ~4-6+ months.)

They gave me a 221(a) to submit co-sponsor information. We could not find any one could help with this. My fiancé thinks that he is making a lot this year and his income could meet the requirement. He is still a college student and will graduate this semester.

if he got another job, how to prove that his income will meet the requirements? should he wait till the end of this year to file a tax return?

They will need evidence of current income.....current income is used to determine sponsor's ability to support new immigrant....letter from employer, pay subs, etc.....

Generally pay stubs + an employment letter is used to show current income for an employee.

The CO will look at the totality of the circumstances to determine the public charge concern, not just minimums. Some may be more strict than others and want to see a longer history of employment than others (i.e. one may be fine with just one pay stub while another may want months of employment).

They've already asked you for a co-sponsor. Your fiance coming in with new evidence from a new job isn't gonna satisfy them. Find a co-sponsor fast. You also can't wait very long to do this because if you do they will consider your application abandoned and send it back to USCIS to expire so waiting for next year's taxes isn't gonna work. They've told you what they want.

That doesnt always work. If the embassy feels beneficiary is a public charge risk. I am $8000 over the guidelines limit and the embassy is still insisting I get a co sponsor.  Good luck

The amount for a 2 person household -your petitioner must make at least $21,575.00 to meet the guideline for a sponsor. And if your petitioner has any household members they are also responsible for, it increases for each person.
