This is new information that I wasn't aware of but like @Chair_force1 stated you can call and they will fax a copy to you. It was brought up in another thread. I was of the same mindset as you and was corrected by another VJ'r who had just called and asked and they said yes the could do that. Surprised the heck out of me.

Yes that was me. Call uscis. Tell them you would like a copy of the rfe because you are on a deadline that can’t be extended. A tier 2 is the only one that has access to those systems. They can also read it to you and let you know what they are requesting.

RE: I-129F Case

USCIS records confirm that the referenced case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed.

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible.

USCIS realizes that the constituent may be frustrated by the progress of their case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

Oh my! Yes I just checked. Well then it's about time to receive our NOA2. Hang in there, guys!!!

Btw, I just got a work offer from an American company which I can do remotely, but the recruiter is from UK. I know once I move there, I can't work til I get my EAD/AP. So should I work with them until my moving day and then tell them I can't work once I'm in the US so my job will be left undone? I can't pass this opportunity

There are several sources that must looked at in whole.

https://www.uscis.gov/working-united-states/working-us

1) You must have a Green Card, EAD, or a work related visa to work in the US

2) "Nonimmigrants enter the United States for a temporary period of time, and once in the United States, are restricted to the activity or reason for which their nonimmigrant visa was issued."

This means unless you have a visa that allows you to work, you are not allowed to. K-1 visa is not a work visa.

You do not become an immigrant until your adjustment of status, and therefore the quickest you are allowed to work on a K-1 visa is once the EAD has been issued.

Then, as far as working in the US for a foreign company goes.... here is a blog post about that has some sources in it

Only 2 of the cases are actually February cases and they were expedited cases. The others are late January approvals. The issue there is there original noa1 is late January but, new site is 3 to 5 days later which puts them into early February.

also, uscis moves forward before finishing prior months dontonback ground checks and other issues.

All we we can do is wait for uscis to do there thing...

I know CR1 team will say CR1 is more powerful than K1. @Greenbaum, I'm fully aware that I can't work until EAD is in hand which may take 4-6 months. Our plan is we'll file AOS ASAP but we didn't know I would get an offer too soon. I guess I will just let my new employer know that my employment has to be "paused" once I move there if they still want to hire me now. Thanks!
