Social Security Number requested while on I94 never arrived - can I send AOS?

No US state requires a SSN before you can get married. However, if you have one then you do have to declare it, since this is a requirement under federal law. But not having one isn't a barrier to being able to obtain a marriage licence.

There are even some USCs still alive today without an SSN. They can marry fine. Often the requirement is that if you have an SSN, you must provide it. If you are excluded from having an SSN, none is required.

Send it asap!

 

Then go back in and try for a different person at the window. The first person we got was incompetent and we believed him when he said to come back 8 weeks later.

 

Keep going back and very politely asking to speak to supervisors/showing them the requirements from their website.

On another note, to the people who mentioned it, there is no requirement for a SSN for a foreign resident to get married in any state. Whoever gave you that information is completely wrong. 

My husband checked the box on form DS-230 requesting that an SSN be assigned for him.  When he arrived in the U.S. we went to the Social Security office to inquire about his card, and the customer service rep said that you can't always be guaranteed it will be assigned.  (Turns out it never was.)  He also said that if you applied for an SSN on your own while one was being assigned, you could end up with 2 SSNs which presents problems of its own.

 

We were married in NJ, and the wedding license application also said that an SSN is required, but when we went to apply, the clerk said it was not required for immigrants who did not have one.

 

I would strongly recommend that you mail your AOS paperwork and, if you haven't received your Social Security card by the time you get your EAD, go back to the Social Security office with your EAD to get issue sorted out.

Actually, I wouldn't recommend that since she has already applied for a SSN. 

OP -- once your work permit arrives, go back to the SSA office and try it again since you should already have a SSN but it just hasn't been issued yet since you are out of status to them. The work permit is proof of being in legal status and will help getting the card issued.

Yes, on the EAD form I did not request a new SSN through USCIS - I'd like to avoid any overlapping. Thanks for your reply

I feel you. Last time I went back I was told "I don't know what happened with your request but now your I94 expired so I cannot check it anymore" after 4 hours of waiting in line (It's that busy at any location in Miami). I was dismissed with no other answers, got out of the office, called them, spoke to a different person, and received a completely different service. She denied what the other employee had told me and quickly found my request, and told me that it went through. Unfortunately you can end up dealing with slacker employees who just want to quickly perform their job without actually helping you.

I'm glad Naes shared me this thread. 

 

I also have a somewhat similar dilemma. We applied for my SSN last June 7th and it's been a month and i haven't gotten my number and card. We went back to the SS office and they said it's still pending from immigration. It's mainly because they're checking my name and it's probably not matching the system. I have 3 first names, a middle name, and a last name. On my K1 visa, they included my middle name on my first name so now i have 4 first names, no middle name, and 1 last name. I understand why it's taking them forever because they basically messed it up but i do want to file my AOS before my I-94 expires next month as i'm scared to be out of status and have nothing filed. 

 

Thanks for all your comments on the OP's inquiry, we will get the AOS paperwork sorted and mailed as soon as possible. :) 

 

*PS. It kinda sucks not having an SS number yet 'cause i can't even get a local state id/driver's license...

Same here, not just a paperwork matter.

In Florida you need a green card to qualify for a driver's license, but it would be great to get at least the state ID, just to avoid carrying my passport with me all the time.

Also, I still can't open a bank account or use the health insurance that my husband extended me. I hope you get it soon.

Yes.

 

I don't think the first guy we got was trying to be inept, but he clearly didn't know what he was doing. The second one figured it out, but we lost 8 weeks following the first guy's directions.

Yes you can send it! Did your SSA office give you some kind of paper/receipt for applying for the SSN? If so, you can include a copy of that with your AOS packet to show you have applied if it brings any peace of mind.

 

Similar thing happened to my husband, although it definitely did not take 3 months - I think this is unfortunately a one-off thing. We were given the same expectation (6 weeks) and ended up having to get married in the meantime and prepared our AOS packet without it. Fortunately, his card came shortly before we mailed it all out so we updated it, but we had a copy of his application receipt that we were going to send with it if it hadn't come.

This is exactly what I'm doing. I attached a copy of the receipt from SSA with a short personal note that explains about the delays.

True. Sometimes i worry about carrying my passport all the time 'cause i might misplace it somewhere. It would really be nice to just have a state id. 

 

Hope we can all get our SSN soon.
