Hi, Please i really i need help. My wife is an American Citizen, we got married here in Nigeria so she left for the State. But she has visited me after we got married. She started the filling in March 2018 which we have already got the NOA1 from the USCIS. Right now she's pregnant and we have this argument on ground where the baby will be delivered. She is saying that, she want to give birth in Nigeria since the papers is not yet out and she can't go through the stress of child birth alone that she need me by her side.

Please i need a good advice on what do now, if i can apply for a B1/B2 visa now or i should just wait for her to have the baby here in Nigeria.

Please any assistance will be highly appreciated.

Honestly, better she has the baby in Nigeria if that's what she feels more comfortable doing, and if that's what she really wants.

Besides, there's always the possibility of your tourist visa being denied.

Another thing to consider if she is in Nigeria now, (not sure by your original post) is also the possibility of her being denied boarding on the flight depending on how far along she is in her pregnancy by the time your visa comes through (if approved)

It's going to be ultimately your wife's choice where she wants the baby. Just accept it. 

 

Also if you're married and filed for k1 visa, prepare yourself for being denied since that's a wrong visa. 

 

Also, pregnancy or baby aren't a ground for expedite just to let you know.

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Your chances for getting a B2 visa are slim to none, so a birth in Nigeria is the only way for you to be  with her during that time.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I really appreciate, she has already filed for an CR1 spousal visa for me already and we are still waiting for the NOA2. But i want to know if she gives birth here in Nigeria can she travel with the child back to the State after some months. Does she needs to apply for a visa for the child before they travel back to the States.

Please i will need an answer to this questions.

She can transmit citizenship to the child by registering the child's birth(CRBA)and obtaining a US passport for the child along with supporting docs at the USEM in Lagos.

To be clear, CRBA is Certificate of Birth Abroad, at the US Embassy in Lagos.  If a US Citizen's child is born abroad, that process must be completed and a US passport applied for and received before the child can travel.  Having the child born in the US, avoids that process, but the more time you spend together in person, the better, in terms of a successful spouse visa process.

Facts are cheap...knowing how to use them is precious...

I have to agree with @missileman with this because there is a high risk of denial for the B2 right now due to all of the above going against you. It's already hard enough trying to get a tourist visa from Nigeria then you have to add in the other elements of this and I have to say it will be a 90% denial.
