Hi all,

I am an American citizen married to an English man who has his CR1 visa interview at London tomorrow.

All things considered, time is up, I just want some opinions, thoughts, and experiences to rest my mind.

 

When our case was going through processing at the NVC, I was a public high school teacher making around 45k in Ohio. My situation has (positively) changed since the case has moved from the NVC: I have started my PhD at an Ivy (couldn't turn it down! Very excited and couldn't be any happier) and moved away from Ohio. Today, I filled out another i-864 with my new income and emailed it to him to take to the interview tomorrow. The funding package I receive from the University PAYS me 32k a year. As in, I get those checks direct deposited into my checking account. I also sent him a copy of the admissions letter explicitly stating my funding salary to him via email.

 

Should we encounter any problems? He has physical, valid copies of the updated forms. I make 12k more than necessary in terms of household size annually. I am just worried that they will see it is from a PhD funding package and dismiss it. We are also worried they will give us trouble because he intends to enter and settle in a city and state different than what was mentioned in the original i-864. Please share your insight and experience with me! Do you think we'll have trouble?

I think he will be fine with the updated financial documents.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

He will be fine so don't worry. If there is a question about it then have him answer honestly and there won't be a problem.

Ohhh BTW Congratulations on the acceptance of a PhD program at a Ivy League school. I know it's tough I am going back to school now for my MBA myself.

It depends on whether the "funding" is actual salary or not.  If it is, and it meets the needs for your family size, there should be no problem.  Chances are, they won't even ask for the updated affidavit.

I just wanna thank everyone for your answers! Things are looking good. And thank you for the congrats! What's funny is, my other "safe" choices, I got rejected! But from my less likely choices, I got nothing but yesses! Grad school is super fickle. The funding is the salary part. The whole package is worth much, much more, but I get paid the actual 32k a year in monthly checks directly deposited to my account.

Depositing checks monthly may or may not be the same as "salary" that will eventually show on a W2.  If it is "salary" you should be fine.  If it's not, then it could be a problem. We try to use the correct terminology here to avoid misunderstandings.  A loan or grant could also be disbursed monthly by direct deposit and would not necessarily be a salary.

Facts are cheap...knowing how to use them is precious...

Nope, it's not a loan or a grant, it's my payment/salary for my research at teaching at the University as a PhD student. No loans or grants on my end! This is all getting taxed, I had to fill out an I-9 when I accepted the spot.

Terrific.  It's best to use the language best suited to the context of the audience, not the internal lingo of an industry or academia.  In an immigration context "funding" an educational endeavor is not necessarily "income".  You qualify as sponsor based on income, wages, salary etc. not funding.

February 2016: We met in our jobs.

May 31 2016: We became a couple. :dancing:

August 16 2016: Engaged.

Thursday, March 22 2018 (Day 210) : Online Case Status changed to RFE´s answer was received .

Monday, April 2 2018 (Day 221) : ¡Approved! Online Case Status now shows Case was sent to Department of State.:dance::dancing:

Congratulations on the approval and good luck on getting him here and settled in. One thing, you mentioned that you moved, if you haven't done so already, it would be a good idea to login to the USCIS website and submit an address change form just so they have your new address on file :). They also state this on the noa's they send out that if the immigrant moves to login to their site and update the address.
