K1 travel ban, what should we do now:(

Hello everyone 

our case was pending at a Ready statues in Abu Dhabi embassy for 50 days and its been 7 months in total process and we were waiting just for an interview and now the ban has gone in effect and all our work is and wait is done. Do you guys know what happens to the pending cases like ours and what do you guys think is the solution or if anything you guys can say would appreciate,

Potential solutions:

 

- Wait until the end of the year, start of 2018 to see if the Supreme Court decides the constitutionality of the executive order

 

- Marry and submit an IR-1. They are exempt from the ban as of now. They will probably still be exempt after, whatever the court decides, because they agreed on the exemption.

Is the beneficiary from one of the countries on the travel ban list (Libya, Syria, Iran, Somalia, Yemen or Sudan)? If so, there is a minimum 90 day waiting period starting today I believe, for further processing of those cases. If they are from the UAE, the ban shouldn't have an effect on them, though processing might still be slower than usual.

I have the same problem as @Sammy949 and as hoping someone could give us any insight on what is to happen next. Waiting on interview date and now this happens. 

 

Is it possible the embassy can pick up where it left off after 90 days?

 

Or will the request be denied and we will have to start over again?

From What I have understood, if affected by this as your fiance is a national of one of the countries listed in the "ban", this will go on for the 90 day period, what happens exactly after that is unknown. The Supreme Court said it would do oral arguements over the 'travel ban' in the Fall. At that point, whether they allow it to be extended, or inact the original complete ban, or remove the ban entirely, is up to them at that point.

 

At this point all can do is wait, or as was mentioned above possibly marry and go for CR-1. Depends how much more you want to wait it out.

Hey guys thanks for reply and my fiance is from Iran. so you think my case wont get returned to uscis during this 90 days? And will day exteneded? Meaning will they keep the file or return it?

One thing you could guys do is a thread for all countries under the travel ban and update the timelines constantly. That will give you a better idea of waiting times. I know that in Iran (there is a thread for that) some people have been waiting 10 months or more at the consular stage. There could be variations in terms of: Is the person from the country a woman? Age? What does the person do for a living? If you guys shared all that info, even create a google spreadsheet, you could have better info to make a decision.

I'm so sorry that this is happening to you and others! I just read an article talking about how they've defined spouse as family, but not fiance. This is such a misguided and ineffective policy. My heart is broken for everyone impacted by this ban. It disgusts me!

You could always go get married and file for a spouse visa.

I thought a fiance or engagement is considered a bona fide relationship.

I made a thread about this and people burned me with proof that a K1 is excluded from the ban because it can be proven that it's a bona fide relationship.  I would check if that's true

DHS has decided that a fiancé/fiancée isn't a close family relationship, so K-1 applicants are included in the ban.

If you havent done it, its too late anyway - but for K1 in UAE you have too book date yourself.

It was true as immigration policy until this administration just now decided it no longer is a valid connection during this travel ban.
School and work is. Fiance is no longer. Go figure.
The Court will look at it in October so everyone should hang on and wait it out until then.
Now fiances that have already been approved and have a valid visa in hand are ok to enter unless they change things again.
With insanity like this who knows what will be next. We will have to watch the airport chaos which will soon follow, immigration lawyers are already
at POE's to watch this mess unfold.
