Hi there

Posting on behalf of a friend who share his suitition with me today he don't have pc to make login id to post question.

 He told me today that somebody came from embassy for verification (background check) before issue the visa as interview was done time ago and embassy had passport and all stuff. The man who came for verification found out that my friend had 2 marriages. 1 who live here and sec who live in usa (the petitioner) .he also told man took somekind of sign on verification paper his brother is law ,casuion,and from his father .

 Now he is worried about and requesting to what to do.

So your friend is married in his home country (wife 1) and also married to an American (wife 2)?

 

If above is true that will not end well for your friend.

Well, does he have two wives? If so, he won't be able to get a marriage-based visa. If the marriage to the local woman ended lawfully before he married the American woman then he needs to provide legal proof of that - but that should have been done with the I-130 and at the NVC stage.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Wait, he married the USA citizen in 2014 and started the visa process, then in 2015 he married someone in his home country? Why?! Did he break up with the first wife?

You really need to give more info. From the little you have said, it looks like he's being fraudulent.

This is an interesting story, but I am not sure where the confusion lies.  He married a US citizen back in 2014, then in 2015 he married someone else locally with apparently the other marriage still ongoing.  I am guessing they did not file for the spousal visa immediately in 2014, but who knows, this could just be a lengthy case.  The long and short of it is he apparently has two wives which won't fly past the USCIS.

I am pretty sure there is nothing that can be done. He committed bigamy(USCIS huge no-no) and not even accidental bigamy which happens innocently from time to time. Honestly, he should probably divorce the American and enjoy his local life with the local wife since he will be getting a material misrep ban most likely. Registered or not, that is why USCIS and the embassy send real humans out to verify these things that happen off the books.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

NO. The issue is not only being married to the local wife, but he also committed fraud during immigration process. He may very well get a permanent ban.

Doesn't matter. Immigration knows about it now. That is why they did the visit/ investigation. It is on his file and he can't go back and erase it.

 

He committed fraud by marrying another woman when he has another wife petitioning him. He is out of luck.
