Why did he say that? Was he just trying to be funny or something? If the CBP officer took him seriously, then that's a legitimate reason to be turned away.

CBP officers have a very important job. They ask the questions they ask for serious reason. Like the safety and well being of Petitioners and our country. They should be respected and appreciated more.

I agree...? By "he" I meant the OP's fiance, not the officer. Of course the officer can ask that.

For what it is worth I did not have a date and really can not remember what I was asked if anything. Something really weird happened.

What many forget, CBP is the last line of defense. Officers inspect hundreds per shift, with a very short window to assess every visa-holder's eligibility and motive to enter the US. A mistimed joke or a vague response is the last thing anyone should attempt.

fyi, I highly doubt that an inspector would ask when are you getting married. Something is very strange about this. Most people are coming of a flight that has been many many hours. They have been approved and authorized to come the USA. CBP already knows that. I can't imagine that question being asked followed by a person being rejected. Unless something else took place and we don't have the entire story.

Just my input. I've traveled many many times internationally and have seen how things work at JFK.

 

I was asked if my fiance at the time was my husband. The correct answer to that was yes that is my fiance. Then I was asked when we would be getting married. I told them we were hoping to get everything lined up for the end of the month. 

They often ask questions to catch you in a lie. Making sure my fiance was still a fiance and not a husband. I can guarantee if I didn't correct them I would have been turned around.

I can only talk of my experience, but I was asked a few questions, including.

 

"Do you understand that this is a 90 day visa?"

"yes"

"You understand what you must do during those 90 days?"

"yes"

 

At the time I interpreted it as being help - he was making sure I understood that I needed to get married and do it within that timeframe.

My Fiance at her POE interview was asked when are you getting married. They want to know if if it's understood that they "have to" get married in 90 days. I'm not sure why so many people are having problems with this.  Just because someone didn't get asked the question doesn't mean it isn't asked. She was was also asked why she had so many gifts and snacks in her luggage but that is a different story.

Thank you to everyone who replied without telling me how he was scamming me or judging him as a person based on what I typed on my first post.  I did not mean to scare everyone currently going through the K1 process, I just wanted everyone to be aware that the process is not over once you get your visa.

 

I hate that he answered the question the way he did.  I hate that an immigration attorney told me that he has no rights until he is in the country so there is no appealing the decision.

 

There seem to be a lot of questions about the process he and I have gone through to get the visa.  It did take longer than it should have, but that was because of other issues with him getting his paperwork done.  I am not sure how that applies to what happened in the customs office at JFK.

 

For those of you who have more unanswered question, please let me know again what they are and I will try to answer them.

Yes, that COULD have changed what happened. It is understandable not to be sure of the date because it depends with the paperworks such as marriage license and stuff like that or other personal concerns such as other members of the family from other parts of the world would like to attend and their dates of availabilities are not yet settled so it is likely to not have the date yet but at least the purpose of the visa which is to marry the person who petitioned him within 90 days is acknowledged. But in your fiance's statement, he has given the officer an opportunity to doubt his intentions of getting in the country.

At this point, I would consider CR1 rather than go the K1 route again if I were you. Just my two cent. I don't know if a cancellation would negatively impact applying for a K1 again. CBP said he could apply for a K1 again, but they can't say as to how difficult it could be the second time around. It could be super easy since everything is still 'fresh' so to speak, or that cancellation could be the clincher. 

 

Please bear in mind that some of the long term VJ members have seen some horrible scams and heartbreak over the years on the forums. I think most who advised or assumed how they did, did so because of this and not wanting to possibly see another innocent person hurt again.

 

At this point, no use with the could have, would have, should have. Just onto the next option for being together for good.
