The K1 process isnt done, When one arrives in the U.S.  There is the Biometrics. The interview at USCIS. The setting of the generally 2 year condition. The interview after the 2 years have passed.Then the removal of the condition. (If reason is found, the condition can be extended.)And granting of Permanent Resisency. Due diligence is key to success, especially in matters of immigration. I once asked a poster if either of the parties read threw the Entier process. And I was told I was abusive and attacking them. After I read threw it all. I hired an attorney. Got screwed and we ended up doing it all ourselves. Due diligence.... Know your path and exactly where it leads and where ends.

Not much has been left unsaid.  The realities are:

 

1) The consulates and CBP are the lines of defense in regard to who enters the U.S.

2) CBP can refuse entry to a visa entrant (such as K-1) on the same basis that a consular officer could refuse to grant the visa.  (This point was made to me by a lawyer during our "time," when I asked about it.  Mrs. T-B.-to-be wasn't "safe" until she made it through the port of entry, having been admitted by CBP.)

 

As has been stated, marriage to the petitioner within 90 days of entry is integral to being granted and fulfilling the obligations of a K-1 visa.  Hence the letters of intent -- the initial ones to USCIS in the I-129F petition, and refreshed ones for the consulate.  The CBP agent in this case acted appropriately, beyond a doubt.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry, but the reply he gave sealed his fate. My fiance studied about port of entry and we went over questions and answers together. He was asked at the Port of Entry if he understood what his visa was for and he replied it was a visa giving him permission to come marry me and that we had plans to marry at town hall on the date we selected. They let him through with no issue.

It is common sense.

You cannot just study POE.You can study Criminal Justice to become a POE officer or to work at the immigration hall.

i think his answer is like that coz he didnt sure if he want to marry his fiancee or he use only to entry  in 

america. coz he loves his fiancee and sure 100% to build a happy family with her in American soppused his answer is not like that. supposed to positive his answer to marry to his fiancee to build a happy family in this country. i didnt understand why he answer like that. this only in my opinion according to his answer why he denied.

He had months to decide if he wanted to marry his fiancee. It's not a maybe yes, maybe no-game.

If you mess around with the Port of Entry officer, he has the legal right to deny your entry. So if the answer is maybe, he is not allowed to have a K1 visa because the purpose of the K1 visa is to travel to the states, get married and apply for AOS. Nothing else.

Is this story legit, It seems there is more to this.  I do think it's crazy to think that one person can decide the fate of another on that level. What if that agent was

pissed off at the world that day and wanted to ruin someone's day if not life. Those people are not paid enough to have that much power. But honestly, I think something's fishy with the story.

It's possible the story is "fishy" and there's something more going on. But yes, CBP officers absolutely have this authority and can make the decision to deny entry at any time during entry to a non-USC. For somebody without resident status and who has not yet established entry into the US, it's even more common and with essentially no recourse. Even USCs have very few rights at POE.

 

How much they get paid is irrelevant.

Common sense and honesty, yes. No reason to study anything, you just answer their questions honestly and nothing more. No joking around, no crazy behaviour, no story telling and so on. Just answer honestly and be done with it.
