So our k1 petition was not actually denied, it was the infamous black C.O at window 5 who felt like messing us up. I wanna know her name. Black elderly woman around her mid 50s.

My woman did some inquiries about our case and it was said that we were not denied. And our case has not been returned to the US...

I'm so surprised at this woman. Capable of feeling normal after separating lovers...

A lot of people refer to KM as a mean black old lady, I don't know if it might be her? How did you find out that you were not denied? Were you instead approved or put into Administrative Processing?

What do you mean it wasn't denied? Have they issues a visa or called you back for a second interview? What did the letter you were given at the interview state? Ghana often takes a long time to send paperwork back to the USCIS.

The lady told me im sorry I cannot grant u visa. We were not approved or put on the AP. At that time we all thought we were denied.

appointment at NVC?

not an info appointment at state office?

recommendations By CO at interview are taken as a decision / rarely overturned by USCIS office which can only be done if the case is returned and applicant allowed to dispute the decision

If they did not keep your passport, you were denied

She may be rude / she may seem cruel / she does get to make the decision and it is up to the beneficary to understand the interview process and know enough about you to convince the CO

this is often a hard and long and heartbreaking process

This sounds very strange. I noticed someone else stated that the case has to be returned before it can be overturned by USCIS. Does it matter that the case is still in Ghana? Have you gotten your Senator involved to inquire on the reason for not granting the visa?

Returned K-1 cases are not even reviewed by USCIS, these are just left to expire.

It's different with returned CR-1/IR-1 cases, these are reviewed by USCIS, although it can take 12-18 months for them to either issue a NOID/NOIR or reaffirm.

Your post actually sounds pretty hostile and threatening. Like, you want to know that woman name and do what?

And yeah, I'm pretty sure she feels pretty good. People are being denied all the time. I'm sure there were some flags in your case that got you denied/AP/whatever happened.

Why are you still chasing the K1 ?

You are married and need to file a I-130. http://www.visajourney.com/forums/topic/601826-denied-k1-petition-now-what/

The reason NVC and USCIS don't see a returned case is because it has not been returned YET.

Ghana will sit on it for about 6 months before they return it to USCIS and once there it will die the death of expiration.

You are married now and the whole K1 is mute.

File a I-30 to start over.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Not to be rude but please don't call her your "woman" :huh: she's not a possession.

Have her contact her senator and see if there's anything they can do to help.
