K1 Allowed to Work

Everything I have read says that K1 visas are not allowed to work. My fiance entered the country a week ago, and we applied for his SSN today. We marked him as a legal immigrant unable to work on the form, and the lady at the office changed it. She said he is allowed to work. I asked if that was true even though he was on a K1. She said it was. He would only be allowed to work until that day in January when his k1 visa expires even though we don't have the green card yet. So? Shouldn't I be able to trust her?

She clearly did not understand the process.

He can not work legally until you apply for AOS with EAD/AP. Once the EAD is received then he can work.

It's because he is allowed to work but only with DHS authorization meaning the EAD card (or GC)

1. Immediately, before filing for AOS. As a K-1 visa holder you are technically eligible to file for an EAD immediately when you arrive. However, this EAD will expire when you K-1 expires (90 days) and because of this and the wait time (>90 days) it is a waste of both time and money to bother applying. You will file as category (a)(6), "Nonimmigrant Fiance(e) of U.S. Citizen". (Where to file: mail, efile, walk-in -- only if local office allows)

Looking at your timeline if you get married in January and send papers in there then don't expect him to work before sometime in April or May.

Yeah, they can be a bit clueless at the SSA. Technically as the Lioness responded a K1 can apply for the EAD, but almost no one does, so technically, as a K1 visa holder with a valid I94 one is "technically" allowed to work with both the SSC and EAD. It sounds like they forgot to mention the EAD part when they responded to your query.

Seconding not to take SSA employees too seriously with immigration. The lady I saw didn't think (in her superior opinion) I was eligible for an SSN. I'd entered with a CR-1 visa.
