My Fiancee's K1 Visa was denied. The CO gave his reason the relationship is not bonafide. We have been in the relationship for over 5 years. To prove our faithful legitimate relationship, USCIS was provided all the documents such as photographs with her, her children , her family and places we visited with date and time all the receipts such as Hotel, restaurants, train , plane and bus tickets.Including financial support and the receipts of the tuition fee for their school and college for the last 4 years, Numerous other affidavits and documents were provided to prove our relationship is genuine. I do not know what to do.The only way out for me to get married. I am facing other problems such as with my work and time. I suppose i have to think of a better way to resolve the issues. Your inputs, suggestions, and thoughts are most welcome.

Any 'red flags'? Obviously you provided material to show the strength and time of the relationship; but was anything said specifically in the interview or asked that maybe could give hints as to why they thought it wasn't a bonafide relationship??

Yep. A lot of people think paying and supporting their fiance looks good, but it can be taken as they are purchasing/buying off their fiance to the CO. It's generally never recommended to show that you're giving money to the CO unless you are married, as it can be showed as commingling finances, but giving money PRIOR to marriage is NOT seen as commingling of finances.

Age differences? Religion Differences? How much time have you spent together in person? Do you know if your fiance answered any questions wrong? What questions were asked?

If you provided EVERYTHING that you could provide and you're 100% confident that your fiance didn't say something that may have raised the CO's ears (either wrong answer, or maybe to much talk about how much money they've received from you), then you probably just need to look at getting married and file CR-1.

I think you shot yourself in the foot by showing financial support receipts.CO might think that your fiancee is using you for money.

Either that the OP is being used, or trying to buy a wife/family. A husband giving money is seen as a marriage doing what they should be doing with their money, anything other than husband can be viewed as a gift, a purchase, a bribe, etc.

I've even seen people here on VJ who were scammed, didn't realize it til it was too late, then wanted their money back from their Ex-Fiance (In this case, the fiance was from the PI and said she was denied at the interview, she never attended and the USC found out after contacting the consulate to try to find out reason for denial). They were met with "Well you shouldn't have sent someone who wasn't your wife money" or "Even if you loved them, you shouldn't have been sending them A LOT of money" or "That was really nice of you, but she wasn't even your wife."

Sending money to your wife = Legit relationship

Sending money to your fiance or girlfriend (they're really weighed the same) = Alternative motives and generally seen as a poor choice

With all that said though, my husband (fiance at the time) paid most my bills and split half my rent with my father. He bought my daughter all kinds of things and sent me money to buy her school clothes/summer clothes/winter jacket. I'm the USC, the CO could have taken it as he was paying me to bring him into the country. At no point did we mention any financials OUTSIDE of the I-134, as any questions revolving around him sending me money or anything were not asked.

You had lots of good evidence suitable for a spousal visa not K-1.

So basically, your evidence was "too good" for K-1 and so it create doubts in CO's mind.

Paying for your fiance's kids tuition may seem normal way of showing you can take care of your fiance to her family but not in the eyes of immigration.

Get married and file I-130.

What did the interviewer focus on when they asked questions?

Was your fiancee denied outright, or given a chance to submit more proof?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

if its denied its gonna go back i am seeing alot or reaffirmed petitions on here. Contact your senators office see if they can have it reaffirmed.

If its at all possible or restart the process i wouldnt give up ;)
