She had her own lawyer to look it over and she signed it, but I'm sure now she will try to dispute it.

You are good, then. Like I said, after such a short marriage, she's unlikely to be entitled to really anything, even without a prenup.

Real bad news. I looks like on the day she left her green card was approved. I just got notified in text msg.So now what? Any recourse? Nothing from the letters I sent, out, but apparently they went out after she was already approved.

Nothing you can do now.

You have waited too long to take action (even before you came on this forum to ask for help).

The goose is already cooked.

Terminate any financial stuff you have jointly with her.

e.g. joint bank account, joint health insurance, bills.

Stop sending money to her family back home. They used you.

If she has nothing much about bona fide marriage evidence, it would be hard for her to remove conditions on her green card.

File for divorce and move on.

Done with K1, AOS and ROC

You can not rely upon her not being able to remove conditions, lawyer up.

He definitely needs to lawyer up to file for divorce and fight against any unreasonable monetary demands.

Still nothing much he can do about her removal of conditions. :mellow:

I came on this forum the day it happened and sent out letters and emails and called local office. Sure there was signs before, but I was hopeful

Too bad You are still one step way behind her.

After divorce she can file a divorce waiver, otherwise she has to wait 2 years to get a 10 year GC.

USCIS pretty much gives everyone a green light to stay in the country once they get to America on a CR1 or K1. Rare is a ROC or VAWA denied resulting in removal. You are on the hook for the I-864 until the conditions are met for it to be terminated. Plan on at least 5-6 years if not longer.

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

If the two of you had financial co-mingling and lived together then after the divorce she can file a divorce waiver ROC, if she has evidence of these. If USCIS approves her ROC, she'll receive a 10-year GC and will be able to naturalize 5 years from now.

To be honest, that may be the preferred outcome. If she naturalizes, your obligation under the I-864 ends.

True. I'm just assuming her ultimate goal is to become a USC, but I very well could be wrong.

From what I've read, "scammy" spouses want to naturalize ASAP to bring over their "real" love, and spiteful spouses want to delay that process and apply for means-tested aid so they don't have to work but can enjoy the relative luxuries in the US. Pretty much lose-lose for the USC spouse.

Being able to receive means-tested benefits depends on the state. Some states only give these out after 5 years of LPR status.
