If it is denied purely for lack of proof, you can ask USCIS to have another look and hopefully re-affirm the petition and send it back to the embassy.

Even if they will not, then spend a few months visiting, and then re-apply. You will need to pay fees and wait again, but you won't be banned or anything.

That being said, you are worried about this now, and still have months to interview, so do something about it now; gather your proof of communcation (phone bills, emails etc), and visit again, ideally once now and a second time for interview, but even once will imp[rove your chances.

Additionally, Australia is not a difficult country to get a visa from, so you may be over thinking this :)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I probably am, thank you. I think I was really concerned about what happens if they do deny it I thought if it was denied you were not able to reapply

It's a worry that many of us have. In reality, the chances are slim in your case. Have you had problems with US immigration in the past? Do you have criminal convictions? When cases are denied it is for huge things like criminal records, marriage fraud, etc. Not just because you don't have many photos or could not afford many visits. You've only been married 6 months so they are not expecting to see years and years of evidence. They understand that. They also understand that for working people the visits are difficult because of the amount of time off you have. Then there is the cost of those flights...

It's a worry that many of us have. In reality, the chances are slim in your case. Have you had problems with US immigration in the past? Do you have criminal convictions? When cases are denied it is for huge things like criminal records, marriage fraud, etc. Not just because you don't have many photos or could not afford many visits. You've only been married 6 months so they are not expecting to see years and years of evidence. They understand that. They also understand that for working people the visits are difficult because of the amount of time off you have. Then there is the cost of those flights...

No you asked about being denied. They were stating your chances are slim of being denied. Work on your relationship evidences as stated before....emails, chat logs, phone logs.

You should be positive. It's too early for these thoughts. Like others said, do something now for prove. Keep records of communication and anything and you will be surprised how smooth things will go for you.

I married my husband and sent paperwork after a month and sent no proof. you can gain proof as the months pass by. every month print out chat logs, calls ect then put them all together and take it to the interview. you already have 6 months of proof already which is good. some of us didn't have that at all. no worries.

Marriage : March 21, 2014
I-130 Sent : April 18, 2014
I-130 NOA1 : April 22, 2014
I-130 Approved: November 14, 2014

The appeal also costs and takes an additional fee

in one case the person won appeal and was told to reapply

so, in my opinion, forget the fee for appeal and the wait time for the decision, and just reapply

just my opinion but ask adiljeanne as they appealed

When I applied for a K1 Visa, we did not send anything except pictures with our petition. We also are considered a "tough" embassy. You will be fine!

Please, refrain from commenting if you do not have the knowledge. The OP is going through a CR1 process, the evidence needed is slightly different than the one for a K1 and Nigeria IS a high fraud country. Remember that your particular circumstances don't necessarily apply to others. In this case, there's no harm and the OP has already received great advise; but your answer can misinform other members.
