Conditional (marriage-based) Resident Status APPROVED!

Oh my gosh, I totally forgot to come back here and tell everyone-- after our interview, we got a notification via online and in the mail that my husbands adjustment to resident status (marriage-based and conditional) has been approved! Details in my signature.

But yeah... Wow, that was kinda fast. We were told ahead of time that the resident status would be "conditional", because I guess they want you to be married for about 2 years, before you can make it permanent... And I believe that couples who have already been married for a couple years before filing can skip that process and go straight to permanent..?? But still, its nice to be able to relax about at least that much.

So... Anybody know what we will be doing after the 2 years? Will they do another interview, sort of like an update before it can be permanent?

If your evidence for a bonafide marriage is strong, they will waive the interview.

This isn't completely true. There is always a chance of receiving an I-751 interview no matter how strong the evidence is that you present.

I believe they actually do, for quality control purposes. To help recognise warning signs, they need a "control group" of interviews that look otherwise approvable, to help adjudicators learn the difference between a normal marriage and potential scammers.

I've been reading up on it myself to try and give an official source, but the links to uscis.gov that I found were all broken. Nevertheless, I believe it still is their policy that between 10% - 50% of all cases recommended for no I-751 interview still receive one, for the reasons I stated above.

They have been known to send RFEs for documents already submitted and to transfer cases to the local offices for interview 'on a whim'. Interviews are not that common though, and I would say it is on the low percentage end at around 10%. The USCIS redacted ROC info released to the public. How their adjudication for ROC cases works seems to be a hush-hush, guarded secret. Memorandums have been removed from the USCIS site too, as Hypnos discovered.

It depends on the local office. When busier, they drop to lower figures (so probably 10% or close to it); in periods of smaller backlogs it probably goes up some (but I agree, not 50% or probably anywhere close).

They don't schedule interviews on a whim. USCIS has enough in their hands already. If there's an I-751 interview scheduled, it means there's something USCIS wants to clarify.

The officer who interviewed us for AOS said sometimes she's sent ROC interviews she herself thinks are ridiculous, such as a couple with a house and three kids, a couple with twins who went through two rounds of IVF, etc. (yes, those were her examples verbatim). So they do schedule interviews when it should be easy to prove it's a bona fide continuing marriage, and even the officers think some are unnecessary.

Regardless of whether they scrutinize and request interview,

if you have a solid marriage, you shouldn't have any concerns

so no sense in worrying ahead of time.
