Lets say an LPR (green card holder) comes back to USA between 6 months and a year and she can't give enough explanation or proof that she has not abandoned the residency and cbp official denies entry at airport ...what happens to money spent on return ticket?

also will same airlines (from which we already will have return ticket)will carry that passenger back on same day....... without any penalty?

because we would buy a return ticket after about 3 months of arrival in USA.

Also, so there is no refund for either arrival or return flight? but what if airlines we flew in does not have vacancy? can CBP put you in other airlines flight to go back?

They will put you on the next fight that does have availability.

Your basic premise is wrong btw.

Yes known sorry.

Oh CBP has no problem getting you on a flight back home. That's not an issue. You don't pay you are being sent home on the US dime. CBP puts you on any flight going back yes it can be with another airlines. No time limit true.

Most people retuned are done so using the return element of their ticket, Airlines are under an obligation to take them back, part of the deal being allowed access.

Expanding on "Your basic premise is wrong":

A green card holder will NOT be sent back on the next flight by CBP merely for suspicion of abandonment. They will either be:

* Admitted (most likely, with an absence of 6 to 12 months and no pattern of long absences beforehand)

* Paroled in with an appointment for deferred inspection or an immigration court hearing

* Persuaded to file an abandonment of permanent residency form (I-407) and paroled in or admitted under the visa waiver program

The LPR will be admitted to the USA if they come back WITHIN a year. A green card holder can leave the U.S. multiple times and reenter, as long as they do not INTEND to stay outside the U.S. for 1 year +. Anything shorter than 1 year is fine. If the LPR wants to spend a year or more outside of the country they need to apply for a re-entry permit Travel Document (I-131). Edited by blest.but.strest

But the question and topic I'd not ask about whether they would be turned away.. But what happens to $ spent on ticket if turned away... Which is they would not get any refunds...

That's theoretically true, but in practice, CBP has discretion to deem someone to have abandoned their status even if it was less than a year. I have seen it happen before.

I have also seen people being made to purchase a return ticket home upon being denied entry, even though they already had a return ticket. I'm not sure what urged CBP to do that to some people, even if they really purchased one-way, because if they got no money, how will CBP get rid of them?

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

If you are a permanent resident of the US why would you buy a return ticket from another country? That is just asking for extra scrutiny at CBP.

Good point.....lets say we dont have return ticket and they deny entry at airport than who pays for the return fare?

People say ...they will put you in next flight available but usually ticket prices are very high if we buy in such a short time...

DO cbp ask us to pay what ever the fare airlines ask for while we are in their custody?

From my understanding it is your responsibility to pay for the ticket but the arriving carrier is liable to return you even without payment, however they could pursue legal action to recover any funds.

Moral of the story: Don't abuse your green card
