I filed in dec 2012. Got my hard copy in June 2013. While filing out the DS 230 form my fiancé remembered he was married and they divorced. This was 18 years ago. He says he has the paperwork to show the divorce but when we initially filed the I129F form he noted he was never married. So now with us about to get our interview date I'm not sure if we can submit an updated I129F form or if we have to start all over again. Has anyone encountered this?? Please help! I'm filing in Vietnam so not sure if that would hinder anything.

He says the marriage happened 18 years ago. I read that some people sent an amended i129f form but I don't know if they were at the same stage as we are now.

Well i am no expert, but if he was married and has the papers to show he was divorced then no problem just bring to embassy and if they ask then you can produce the papers, but your already at the interview level . so to start over if along wait.

but if he dont have the papers and they ask well then that would be red flag #2

i have rememberd my marriages even they are over 25 yrs ago , i would like to forget :)

I'm assuming I can just send an amended I129F with him to the interview or to submit for the interview? He told me since it happened 8 years ago and he forgot about it until recently when he found the divorce papers.

I'm sorry but this seems too odd for me.... I don't know your story together but I don't think i could trust anyone that give you an excuse like that... I mean... what else is he hiding from you??? My hubby was married before, just for a year and more than 30 years ago and believe me, he remember....

I love you Charles forever!!

really strange, if some one forget about marriage, any ways what i know from some of my friend's experience, see if u get ur interview date n if u want tell CO, all the truth then i dont remember the exact section Immigration Act, but it says something like this if CO, found anything different from the time of petition filled, so CO must send back to USCIS for review, otherwise u cant send ur I-129F by yourself, what i suggest to you wait till ur interview n then CO will refer ur case back to USCIS n its like reapply for I129F, n DONT FORGET ANY OTHER MARRIAGE IF HE/SHE HAD.....

TRUTH ALWAYS WINS....................BEST OF LUCK

Not sure what you can do at this point other than have a corrected I-129F and his divorce decree on hand for your interview and hope for the best.

I wish I could forget my first marriage, well most of it anyway. I just don't see how it is possible to forget being married.

For certain, must to show his certified copy of divorce decree on your interview day.

as to correcting the I-129F - I be clueless.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

When I asked why he didn't tell me his response was you never asked :/

Then I mentioned that he saw the paperwork and he goes I don't understand English. I'm livid at this point cause I freaking translated it for him! I don't even know who to contact about this :(

Wait, I am assuming you are the petitioner. You filled out the I-129 and in filling it you asked if he had been married before, yes? Therefore you did ask unless you just assumed. And the paperwork you translated was that from Vietnamese to English? Does he read Vietnamese? Seems he probably understood what it was before you translated it. Something doesn't add up or I am missing something here.

So if you didn't ask he never would have told you, seriously? He didn't forget, he just didn't want to tell you. Lying or omitting something like this is material misrepresentation, and could carry a potential ban. At this point it would probably be a good idea to contact a GOOD immigration attorney.

He has a daughter. And he told me about the baby momma but apparently this union was BEFORE the baby momma. I gathered his information and translated the question to get his answer. He only informed me about the baby momma.

It wasn't until recently he found his ex wife on Facebook!
