I married a Turkish citizen and did all the immigration processes to bring him here and get his permanent greencard. He's been in the USA for 5 1/2 years.

We separated recently because he is physically and emotionally abusive to me and is dangerous. He tried to attack my friend with a knife and is now wanted by the police in 3 different states. His family and his employer are helping to hide him from the police. I have a restraining order against him and his associates.

I will be filing for divorce this week. But I'm not sure what to do about his immigration status and the documents that I completed that makes me financially responsible for him as I am is sponsor. How do I remove this?

Am I able to report him to immigration that he is a fugitive?

I can't afford an attorney as he has drained our bank account and I've had to get everything closed/changed in order to stop him from destroying my credit.

You cannot cancel sponsorship. You should write a letter to USCIS/ICE letting them know he's a fugitive.

I discovered that if I file for divorce that I can send a letter to immigration asking to have my petition for his green card to be removed/cancelled.

I can also include a copy of the police report and restraining order. This sounds like a way to get out of the sponsorship as once the petition is cancelled out, then the sponsorship is also.

He has a GC, you can't withdraw your petition, or your sponsorship. If it makes you feel better to try, go ahead.

Where did you "discover" this out of interest? It's a lie of course in your situation but if the GC hadn't been obtained it would work. Perhaps you misread it, or it could be wrong.

You can ask, but it's not going to end the I-864 obligation.

You bring a person to the US, you vouch for him, and you guarantee that you would be responsible for him. It's that simple.

You cannot get out of your I-864 obligation because of divorce. And it doesn't matter that he's a fugitive. Innocent until proven guilty, so USCIS and ICE cannot do anything about him.

You are stuck with the I-864 obligation until one of the events listed by USCIS about ending the I-864 obligation occurs; I suggest you read the instructions for Form I-864. Notice that divorce and being a fugitive is not one of the cause for ending the I-864 obligation.

Please provide a citation for your "discovery."

Your "discovery" is false information. You cannot end the sponsorship or do anything that will result in "removing" or "cancelling" his green card. It is too late.

If he has a felony then ICE will want to know to find him and deport him. Then you will not be responsible for him.

So contact ICE and send any court documents or police reports.

And pray they find him, detain him and send him home.

He has been here 5.5 years so why did he all the sudden become abusive? drugs? alcohol? Or was he always this way and you finally had enough?

** Moving from NVC to Effects of Major Changes forum ***

Your I-864 responsibility doesn't end unless they deport him for felony convictions, which they may not do. However, he seems to be elligible for US citizenship. If he gets that, your financial responsibility would end.

Oh if the knife weilding is correct ,and fugitive status then ICE will sort it out eventually, you can report him on the criminal alien 800# too after you file the divorce ,until he leavesI I you are financially responsible, he has his GC it cant be revoked if he supposidly abused you, you should have called the police or seek medical attention so he'd be charged with domestic violence & deported. Personally ppl need to really get to know anothers culture B4 jumping the broom.

I don't think the "culture" had anything to do with it. Every "culture" and nationality has their good and bad. Are you saying that there are no bad people or criminals in your "culture"? An abuser is an abuser and a criminal is a criminal. There is no discrimination for race. religion. nationality, or sex when it comes to breaking the law. The OP says he has been here for 5.5 years so I am sure they know eachother very very well by now.

naaah - wont work. This is not even a reason to request cancellation ... unless he mis-rep himself to you/immigration.

domestic violence isn't grounds for automatic deportation. .. not now nor in the past. Heavy charges allows the board to review the legal alien... usually it's several charges that will hit to have caused a revoked status.

this has nothing to do with culture, there are millions of american men who are physically and mentally abusive to their wives. This couple has been married for over 5 years, it isn't a cultural thing!!! Sounds to me like you are blaming her for the abuse
